Regardless of being a business or not, the APRA would probably define it as public performace and you would need to pay for it.

There's no point asking APRA and PPNZ, representing the recording industry they will say that you need to pay no matter what you're doing.

You should contact APRA and PPNZ regardless. You are 'broadcasting' as such when you play the song to someone over the phone when they are on hold.

perhaps it's not 101% legal. however - will it cause people to lose money ie people wont 'download' the poor quality mono songs from your hold music.

secondly, every business i know have radio songs as hold music. isnt this just the same? do every business with hold music on their huge phone systems apply for some kind of licence? do every shop that plays a CD or the radio obtain licences?

but well what do i know!

I have never heard a business with the radio as hold music... interesting.

Any public performance requires a licence. Cafes and shops pay for these licences. There was a crack down a few years ago if I recall correctly. It was in the news for a while.

And if not.. then they'll get caught sooner or later and heavily fined/have the fees backdated.

wow i really didnt know that. many cafes around here i go to plays random CDs. seen the warehouse worker plug in her ipod. pretty sure the manager didnt apply for licence for every random song they played! good to know that though ...

Its not for every random song. I believe it is a flat fee to play music.
