Zeon: I don't think that these types of advertisements should be censored. Risk of defamation is the usual way to discourage this type of advertisement.

While there seem to be screw ups in the government operation against him, he is some kind of saint in people's eyes now? People seem to forget the underlying reason for him getting in trouble.....

A: He's 'innocent until proven guilty'.

B: Even if he is guilty, does that make it OK to mount this particular ad? Don't think so.

If I was dotcom I would get my money back, buy Tui - shut it down. Rebrand the company, re-employ all staff except CEO and marketing team, and call it something like - Magpie (I take shiny things I don't need)

What happen to the basic tenet of law that a person is innocent until proven guilty?

Who cares?  This ad is clearly an attack on his wife as well, so even if you skip right on past that whole "innocent until proven guilty" thing for Kim, she actually is innocent.  Plus let's not forget that it's a broadsided attack at every single overweight person and their partners, whether DB intended it or not.  And that actually does qualify as a breach of the advertising codes.

Oh, and the government didn't write the rules - the advertisers themselves did.

This.

I could think of lots of rude things to say about Kim.  I think he's put him self out there to be a target in so many different ways.

However I draw the line at attacking his wife.

I can personally relate.  I post in the public space, some times I say stuff that is moronic, I fully accept that.  But I'd be pissed if people came at my wife and son in this way.

Agree. They haven't just crossed a line, they've blasted past it.

You missed a word - "criminal", it comes just before "law".

"Schmitz moved to Thailand to avoid investigation[12] where he was subsequently arrested on behalf of German authorities.[15] In response he allegedly pretended to kill himself online posting a message on his website that from now on he wished to be known as "His Royal Highness King Kimble the First, Ruler of the Kimpire".[15] He was deported back to Germany where he pleaded guilty to embezzlement in November 2003 and, after five months in jail awaiting trial, again received a suspended sentence (of 20 months).[31] After avoiding a prison sentence for a second time, he left Germany and moved to Hong Kong in late 2003.[12]

Schmitz found Hong Kong to his liking and registered Kimpire Limited in December 2003, soon after moving there. He set up a network of interlinked companies, including Trendax which was claimed to be an artificial intelligence-driven hedge fund delivering an annual return of at least 25%.[32] However, Trendax was never registered with Hong Kong’s Securities and Futures Commission and the company was legally not allowed to accept investments or to conduct trades.[18] Dotcom was subsequently convicted for failing to disclose his shareholding to the Securities and Futures Commission, and was fined 8000 Hong Kong dollars.[24]"

He was guilty of those things, yes, but that has no bearing on whether he is entitled to be treated as innocent until proven guilty on the *current* charges.

And let's not lose sight of the fact that he's accused of knowing that other people might be storing copyright-infringing materials on his service... That's all.

The same thing that Google, Microsoft, Apple, Amazon, Dropbox, Sugar and a thousand other cloud services do. He's just an easier target, thanks to his inability to shut the hell up and keep his head down. That and the fact that the first four above can afford lawyers as good as the media companies.

On the topic of DB Breweries, copyright and Germans - I still won't buy Monteiths products until DB relinquishes its claim on the word radler. I should probably extend the boycott to all DB's products.

My comment was clearly quoted, so please don't take it out of context. I will quote again:

Zeon made a reference to the general public perception of Mr Dotcom being "some kind of saint in people's eyes now". In his reply nakedmolerat seems to either be ignorant or ignore the that Mr Dotcom has been previously convicted.

In no moment I said anything about his current situation in front of the courts. My comment was clearly aimed at the two posts quoted in the context.

Don't twist my words.

Sorry, I didn't mean to twist your words. I misunderstood you. :-( I completely agree that he's no saint.

Considering his coverage in the media at the moment, DB have jumped at this perfect opportunity to create some controversy and get some free publicity.

Like Hell who do this *all* *the* *time*, the media mindlessly lap it up, all while giving Hell publicity they couldn't pay for.

Slightly off-topic, is anyone else amazed with at the love affair we Kiwis have with the portly german fellow?

*Shrug*

I have to admit to admiring the way he continues to give the big finger to the media companies by carrying on with things like Mega. His self-publicism is breathtakingly audacious too (free fibre anyone?).

But hey, what can I say? I'm a 1st Fleet Aussie with an honest-to-god bushranger in the family. I'm descended from the kings and queens of thieves and other assorted rogues. Of course I'm going to love him.

Edit: bah - I accidentally a word two.
