Plenty of cameras look like phones if you don't look at them too closely. You have the photo right? Yes I still have the photo, I could argue it was a camera, because while he was walking over I had put it back down and he wouldn't have been able to see it ( did not do this to hide it, I actually didn't know he was coming until he was like half way there.) A breath test checkpoint would be considered a flow of traffic, and police officers will walk across the flow looking at reg, WOF, tyres, doing breath tests, looking at passengers, looking at seatbelts etc. I feel dumber reading this thread. You might get a ticket, because you used a cellular telephone whilst you were in control of your car in a motorway lane in a situation where traffic may have been directed to move. Part of the problem is that laws don't keep up with technology. A phone can do so much more than simply make calls and txt. It could be used as a GPS device or camera, and if you were handling either of those dedicated devices in your car, they wouldn't probably care. But because it was mobile phone shaped, then the law kicks in, and it is probably very difficult to prove that you weren't txting or making a call when you pick up a phone in a car.

GPS on a phone is perfectly legal, providing the phone is mounted. If I recall correctly there was an addendum to the law shortly after it was put in force. Using a mounted phone to make/receive calls is also legal. Just don't handle the thing. Offense can never be given, only taken ...
