What if you're t-boned? My only car accident was caused by this driver not giving way and scraping along the side of my car (it was wet so breaking caused our cars to continue to slide). Landed her a $1,700 bill for repairs to my car.

You clearly weren't aware of the rules, because there is nothing to interpret!  Either it was normal flow of traffic, in which case using your phone for anything is an offense, or it was not normal flow of traffic, in which case using your phone for anything bar calling is an offense.

You broke the law.  There is no other way to interpret it.  I would be right behind you if you were calling someone to say you're stuck in traffic at an accident and would be home late and the officer ticketed you, but that isn't the case.  You text messaged (illegal) and you used your phone to take a photo (illegal).


Well no, I didnt text message because the message wasn't opened, I glanced at the lock screen before going straight to the camera.  It doesnt specify anywhere that taking photos while driving is illegal.

How was that not paying due care? The car was entirely stopped, anything else that happened would have been the result of another driver. The two seconds it took to take that photo would have made absolutely no difference to anything that could have happened. If you're saying me taking this photo while the car was stopped was dangerous, why havn't they banned people from eating while driving full speed on a motorway? as far as I can see, thats far more dangerous, hot food = possible risk of burning yourself, then you'll focus on treating said burn and loose focus of driving 100km an hour. 

You tell me I'm being dangerous next time you change radio stations, skip songs on a cd or adjust the AC in your car while actually driving, not being stopped with no where to go.

http://www.nzta.govt.nz/resources/rules/docs/road-user-amendment-2009.pdf : “7.3A Ban on use of mobile phones while driving“
(1) A drivermust not, while driving a vehicle, create, send, or read a text message on a mobile phone or make, receive, or terminate a telephone call on a mobile phone or use a mobile phone in any other way. This subclause is overridden by subclauses (2) to (6).

That was in response to saying car crashes were normal, which they are not and I'm fully aware of that. Car crashes are the result of people not driving normally, normal driving doesn't have crashes

It says, quite clearly, that using your phone for anything is illegal while driving, and using your phone for anything other than making phone calls is illegal while stopped in abnormal traffic flow.  Where do you get your information?
