richms: Not peer to peer, but good luck throwing some complaints out there ;) at $25 a pop for ISPs to say no, they will love the extra income.


The law says nothing about it having to be P2P as far as I can tell

It was a vauge and stupid wording of it, but it had something about connecting to multiple users in it and the general view is that its not supposed to cover hosting based downloads. You cant prove that anyone made a copy of things just by the fact that there is a http request either.

I think the best way to spam the system is simply to send out requests for copyright that you don't own. Since the challenge-response system is basically:

1. SaltyNZ: I am the rights holder, and I complain about richms
2. Richms: I challenge you to prove you are the rights holder
3. SaltyNZ: I reject your challenge
4. Complaint upheld

If the rights holder rejects your challenge then you are considered guilty. You actually have to get to a hearing before you would be forced to prove you had standing to send the notice, and I'm not even sure it would count even then, the way it's all setup.

Interesting experiment.

One thought I have - what effect does hyperlinking to the file vs not have on my rights? Currently the file is hyperlinked in your OP... so tempted to click...

What would happen if I quoted the contents of the text file here in this thread? Would Geekzone members automatically become guilty of infringing copyright just by reading the thread? Or would it just be me in trouble for making the infringing copy?

That's the silly thing, even by viewing the thread you're placing a copy of the content in RAM and probably your browser's disk cache. Would that be an infringement too? It's obviously not P2P but I'm thinking of the wider issue.

Well, if my calc is right, LennonNZ has made at least $1m so far if all cases are hit with the maximum penalty of $15000 :)

The thing is.. Even if he went from a Vodafone cell phone connection I can still claim copyright take them directly to court for copyright infringement and not care about this new law which has come into affect. 

I don't have to pay $25 to the ISP just go straight to the court.. represent myself .. hardly any cost (yea right)

You altered the original works.  Is that legal? 

Seems to me that you've republished someone elses works, given it a new title and are now hosting it on your own web site.

...or am I just reading it wrong?

Edit:  and it's just occurred to me, how can I be sure that this is the same as the original?  I don't have rights to view the original... I'm so confused - beer.
