No they don't.

Most companies would honor a mistake but until the contract is fulfilled, i.e. you place the order and they take your money there is no obligation for them to supply you under those terms.

As far as availability is concerned, they may have availability for the phone on the 24 month plans but no other options, they may be available but Vodafone choose not to ship for 14-21 days, that is their right.

You really need to get over it and wait for your phone of buy a Samsung S3, no matter how much you harass a customer service person they are not going to change their policy for you, be it Apple or Vodafone, they simply don't have the authority to do it, quite frankly you were rude and obnoxious.


Come on dude you are the one who sounds rude... every one on this forum has been looking at a way to get the iPhone5 early as possible and we will try every thing we can. Now if you dont want to do that  fine but dont just be rude.

why would i be posting on this forum daily if i wanted to buy an S3? there **** 

no rudeness going on there just pure lack of info from Vodafone, that women clearly didnt know what she was talking about, stock with Vodafone that takes 14-21 days to ship doesnt make sense! 

your post was completely useless... i wasnt asking for a change of policy! ok if you say so, considering i have managed to get Apple to expedite my order, trough clever complaints, you need to know what your talking about and have a decent argument... quite clearly, you dont!

Unfortunately not.  There are clauses in the law that permit a company to refuse to complete a sale where a genuine mistake can be made, especially if the consumer had good reason to believe it was an error.  So they can in fact refuse to accept your order and you would not be able to have them up with a false advertisement complaint.

FFS, Just reading the latest pages of this thread.

Never has it been so hard to actually buy something that's supposed to be for sale.
It's patently ridiculous.

A product is for sale: people want to buy the product at a price determined by the maker of the product but the damn middlemen don't want to sell it outright yet because of greed; that's all it is; pure GREED.

Telecom and Vodafone, get your ****** acts together and stop being b*stards.

We've actually had it pretty good.Until the iPhone 4 they were only able to purchase it on contract on AT&T. But I guess that feels recent but was two years ago. It's really Apple's fault. We don't make a big enough splash in their bank account so why should they bother with prioritizing stock to us?
And as has been said, VF and TCNZ make little to no profit on the handsets alone, why would they sell it outright if they could, for the first month, make money on contracts?

Blame it on Apple for being greedy and only giving a 2% ~ 3% profit margin on their hardware like iPhone. Telecom and Vodafone are looking after contract customers because that is how they will make money out of selling Apple products. Prepaid customer can jump ship anytime and they do jump ship anytime.

I thnk there is customer satisfaction from the providers. There is no satisfaction if a person buys outright from one provider then uses the phone at another. At the moment, the providers are selling to their customers, who will be for 24 months. Imagine if they ran out of what is probably limited stocks for their customers, as others had moved the phone to another provider? I assume if the stocks were higher, there would also be a 12 month option.

So, you can buy from a provider, who will wish the phone to be on their network, and structure the terms accordingly, or you can buy outright from Apple. All in all, a very clear and understandable situation.

Whilst I can understand why people want the phone now etc, with all the talk of "Scuffgate" and other issues out of the box and knowing how retailers in NZ can often resort to "Blame the customer", I'd be far more comfortable with buying from Apple with the cast-iron guarantee of a 14-day right of return. This is prety much why I am just waiting on Apple.

Went into Yoobee today by the Britomart and they had only just gotten their demo delivered, they said they could only sell on contract as that is what Vodafone had instructed them.

This isn't just a VF or TNZ thing...

Globally there are very few (if not any) places that are selling them outright.

I would think there's much more at play here than local telco's

Was just talking to my sister in Canada and apparently you can only buy them attached to carrier at the moment, even in the apple store.

Contractual obligations between both parties, at a guess.
