lately my bandwidth seems to be maxing out at 4megabits during peak times.
even to the orcon speed test.

non peak seems ok, so was just wondering if im now in that de-prioritised pool :(

I would guess that tests using speedtest.orcon.net.nz won't be affected by the bandwidth pooling as it's all local within Orcon's network. In saying that, I can usually get line speed to it. Tonight I can only reach 4mbps.

Are you in Auckland? There seems to be some regional peak time congestion affecting some suburbs for a few ISP's in the last week or so (see Telecom and Snap threads).
