So.... the Title says it all.....


I own an HTC one X, but just over a month ago I had some technical issue with the handset so took it to the store I brought it from Ezigadget.co.nz. I brought it from there store In Dukes Arcade, Maners Mall,Wellington.

The phone was sent to his Auckland tech center who confirmed that the motherboard had a manufacturing fault and needed to be returned to the factory to the be repair or replaced.

Today I was going to check in on my warranty, so I googled the Store to get the phone number (seemed easier than getting all the paper work out) only to find this posted.

Due to personal circumstance, we have come to the conclusion that we can no longer serve the customer as we would like in our business endeavours.We are therefore reluctantly forced to anounce that we are closing down on 31st Oct. 2012.

We would like to take this opportunity to wish our customers and clients the very best and thank them all sincerely for their support.If you need to claim the warranty, please email us to manager@ezigadget.co.nz or wmanager@ezigadget.co.nz
This as you can suspect had me very worried. I then got the paper work out of my back and phoned the number listed only to find the phone had be disconnected.

At this point I ran down to the store in the hope of talking to the manager only to find the store closed and stripped empty with a real-estate agents sign in the window.

I managed to obtain the managers personal cell phone number and phoned him, he was very defective and cagey.

He told me that he was no-longer running the store, that "I don't work there anymore" He then said he would follow up on my phone for me and was in the middle of writing a email or Text to everyone with outstanding issues, he then tried to imply he was starting up an online only store but as you can tell the only site has been taken down as well.

So any-how.... long story for a simple question: Do you think I have legal grounds to ask for a cash refund, It has been over a month, his own tech team said it was a factory fault and I have very very strong fear that he has infarct liquidated and has no intent to honor my warranty.

Thanks team I know this inst really a Android tech issue but any help would be great!!

Yea Emailed them with no reply.

But I have intercepted that with my phone call. just very un-nerving and embarrassing when im so vocal about android/parallel importing when people ask.

This reminds me very much of a few years back when C1 Shopping Mall closed down and left many warranty claims unresolved.

I hope for your sake that you get your phone back repaired as if they have gone into liquidation you will just go onto the list as an unsecured creditor which makes the likely hood of getting your full amount of $$ back unlikely.

I think if they can prove ownership of the phone, then the receivers can't sell it. But it doesn't sound like the company they are dealing with has gone into receivership/liquidation, because if they had I think they would have to put that on their webpage. The OP should check with the companies office as to the status of the company, and if they can't get anywhere, they should possibly make a claim with the disputes tribunal. Possibly talking to the CAB could be an idea.

You really need to check if the company has been placed into receivership or liquidated and if so file a claim with the receiver ASAP. If you don't you've got even less chance of seeing your goods again!

Does anything in you paperwork give you the actual name of the company, ?

How do I do that?


The tax receipt should give you the legal company name.

I can see that the domain is registered under ezigadget on the NZ whois database, but can't see that company name listed on the companies website.

Check with the companies office once you know the name of the company.

The CO website will tell you if they're in receivership/liquidation and who is handling it.

Get their details, phone them up and explain your situation.

Have you got receipts for the phone in the first instance? Even a credit card statement or similar should do.

My experience with liquidators is they take their own sweet time but they will work to get something like this sorted out.

I think CAB is a good move!

Issue is however I think he may have been trading as a sole trader as I can not find EziGagdet or any other name listed on the above site.

The only other thing I have on the original receipt or the warranty documentation he gave me last month is his (or his company's) IRD number.

Did some digging and found a copy of his invoice letter-head here.
(Sorry not sure if that is against the Forum rules, if so I can remove it)

Can a company be found using this IRD number?

You could always check the 'way back' link and then check the companies referenced in the Terms and Conditions with companies house.

i'm in the exact same situation(actually what brought me to the forum)

did you find a happy resolution? I'm looking for one myself. 

also, any chance you can share the guys contact info privately? I need to contact them because he has my galaxy nexus and that is a big investment to just write off......

I am in exactly the same situation with my phone - put it in for warranty in late September, tried to phone them to see where the process is at, and Googling brought me here.

Has there been any update on your situation?

Rookie question - is CAB the consumers advice beurau? And what did they tell you?

Did their IRD number assist in tracking them down?

i got an email reply from the manager, who is apparently out of the country. He told me all the already-repaired phones are with a friend of his. He gave me the guy's number - the friend apparently has all our phones and is going to return them as they come back "as a favor" to the ezigadget manager. He claims to never have worked at Ezigadget.

I basically told him that if I dont get my phone back in a couple of days I will call the police and report them for fraud/theft, but he acted real lazy and basically said he'd get to it when he can.
