Was the women in the right?
The herald article claims she was charged with being drunk in a public place. How can that be?

I clicked on your herald link, read the first sentence and then proceeded to bash my head against a concrete wall.

I think the woman was a danger to the public. Surely a horse is classed as some kind of vehicle.

OP I am not sure what you are questioning, are you questioning that she was drunk, or that there is a charge for being drunk in a public place.

What she did was plain stupid, owning and training horses, I can see from the video the horse was very close to being in flight mode, when a horse is in flight mode it looses all sence of its training and would easily mow people down in order to get out of the situation.

the police needed to act in a way to defuse a dangerous situation, which from what I can see they did.




I know a little more than nothing but not much...

Land Transport Act 1998 section (2)(1)

vehicle—
  • (a) means a contrivance equipped with wheels, tracks, or revolving runners on which it moves or is moved; and
  • (b) includes a hovercraft, a skateboard, in-line skates, and roller skates; but
  • (c) does not include—
    • (i) a perambulator or pushchair:
    • (ii) a shopping or sporting trundler not propelled by mechanical power:
    • (iii) a wheelbarrow or hand-trolley:
    • (iv) [Repealed]
    • (v) a pedestrian-controlled lawnmower:
    • (vi) a pedestrian-controlled agricultural machine not propelled by mechanical power:
    • (vii) an article of furniture:
    • (viii) a wheelchair not propelled by mechanical power:
    • (ix) any other contrivance specified by the rules not to be a vehicle for the purposes of this definition:
    • (x) any rail vehicle

A friend of mine was caught riding a bike drunk by the police, but a horse... that's an interesting one.

According to Wikipedia:

Being drunk in public is not specifically an offense unless the person who is intoxicated is a public nuisance, in which case they may be dealt with for 'disturbing the peace'.

Sounds like some of the bystanders should have been breath tested as well looking at the video...
