On your privacy policy page, many sentences are capitalised, and many are not.

e.g.

(a) Those who provide to us or our group companies products or services that support the services that we provide, such as our dealers and suppliers;

(b) Credit reference agencies (unless we have agreed otherwise) who may share your
information with other organisations and who may keep a record of the searches
we make against your name;

(c) if someone else pays your bill, such as your employer, that person;

(d) those providing telephone and similar directories or directory enquiry services;

(d) Text charges will apply even if the messages are not received by the intended recipient for whatever reason.

Sounds to me like you are potentially (and possibly unwittingly) contracting a customer out of the Consumer Guarantees Act, which is not allowed under NZ law.

If a customer sends a text, and you do not have the ability to pass it on, because of say, an outage, breakdown or whatever, then you will not have given the service paid for, and under the CGA will be required to rectify that (by way of a refund/credit or put the service right and deliver the message).

Some of your headings are completely capitalised...

e.g.

2 USE OF OUR WEBSITE

But some are not...

e.g.

38. B+W Mail (Email) Service

Error: Inconsistent formatting.

  • Nobody is paying me :(
  • Yes I really want a Centro. A free one even.
  • I have mowed the lawns, walked the kid, emptied the pool and waterblasted it, dismantled/cleaned/remantled the BBQ, bought all new socks and discarded old ones with holes + much more :-)
  • I am not a moderator these days. Please research the term Emeritus :-)

3 APPLICATION FOR SERVICES/ORDERFOR PRODUCTS

Typo - there should be a space in there somewhere, between "ORDER" and "FOR" (Which shouldn't be all in caps anyway - but I already covered that).

OH MY!! Where to start with this train-wreck of a set of clauses...

My notes in bold throughout...

2.5 As a condition of use of the Website, you agree:
(a) Not to disrupt activity online;
(b) To ensure that the Website, Services and Products are not used for any illegal
activity
or which may expose us to potential litigation including (but not limited
to) copyright and trade mark infringement, the publication of obscene or
defamatory information or material, information or material that infringes the
rights of third parties, or is likely to be misleading or deceptive or otherwise
breaches the Fair Trading Act 1986;

You want me to ensure that the Website is not used for illegal activity? Huh? What? Thats YOUR job!!

Pay me to come aboard as your security expert if you want it to be MY job :)

(c) Not to use anybody else's computer system, communications services or data,
including by hacking or by attempting to circumvent user authentication or
other security measures;
(d) Not to post or use any software or device which may facilitate a continued
connection or degrade or impede the service of another user, such as pinging,
mail bombs or war dialling;

War dialling? McSqueeze me? If you can tell me how I can use your website to dial a phone number, I will give you a look at my Palm Centro if I win.

(e) Not to run network scanning software or use open relay to distribute messages;

You have an open relay on your website? Excellent!

Let me know the address, and I will promise not to use it to distribute messages.

and;

(f) Not to introduce anything harmful or destructive (such as viruses, worms,
Trojan horses, time bombs or bots) to, or interfere in any way with B+W’s or
anyone else's computer system or communications services.

Is that 1, 2 or 3 more entries for me? (Three is good).

(b) Nothing in these Terms and Conditions is intended to have the effect of
contracting out of the provisions of the Consumer Guarantees Act 1993 except
to the extent permitted by that Act
, and these Terms and Conditions are to be
modified to the extent necessary to give effect to that intention.

Pointless statement - the Act does not permit any contracting out of itself.
