neb: We're just talking past each other here, go and google "doctrine of command responsibility" and then we can continue the discussion. Or, to make it easy for you, quoting the Oxford Bibliographies in International Law:
The doctrine of command or superior responsibility stipulates that a superior—a military or civilian leader—can be held criminally responsible when his subordinates commit international crimes. The doctrine has become part of customary international law and has been incorporated into the statutes of the international criminal tribunals and into the Rome Statute of the International Criminal Court (ICC).

The doctrine of command responsibility a.k.a. the Yamashita standard means Putin will almost certainly be held responsible. The comments in the story on this indicated that that's what they're looking at.

 

You've replied to the quoted post in a different context than it was written and also mine. 

 

 

 

The White Houses' "official view" that Putin committed War Crimes is just that - a Point of View, with no legal weight.

 

Simply put Washington on the record supports any potential investigation and/or legal proceedings against Russian commanders charges of War Crimes.  

 

That is NOT the same as Biden stating "Putin committed War Crimes".

 

 

 

War Crimes or Crimes Against Humanity convictions are determined by ICC trial, not Politicians.

Its outside the terms of the contracts. So its a no go. Russian stick market opened up trading for I think, 15 stocks, all going well. Except its fake news. Its a lot like Trump, say and do stupid things, unaware that everyone else sees through it, and the lies. 

 

Fixated. But Id have to say, with his emotional need to Make USSR Great Again, his brain must be doing it hard with virtually everything related to the war, and Russia, being negative. Early on while media praised the resolve of Ukraine, we all knew it was a slam dunk, and Russia would roll them. My God, how its evolved. Now, there are areas where Russia is being pushed back, a ship destroyed in a Russian held port. If he cracks, and there is an "accidental" strike on NATO land , or a sniff of chemical warfare, it may well be over the red line, and NATO attack hard.

If ALL the money from this, every cent, is not going to Ukraine, then shame on them. Damn them to hell. 

 

People are dying. Cities are being destroyed. Homes are being razed. Hospitals and schools are being bombed to rubble. Anyone who makes 1 kopek off this humanitarian disaster and does not pass it on to the victims is cursed and should die a lonely, painful, prolonged death.

I am only half way through but I will definitely get back to finish it. It all now seems obvious what should have been done to stop bloody Putin. Bullies don't stop by giving them a tongue lashing. Threats of sanctions and other non direct military support have never stopped the tanks when they start rolling, he says. 

 

When do we decide to intervene with weapons and troops? What number of destroyed cities and number of refugees does it take? 

 

Bullies have to be faced up.

I'm particularly disappointed with Germany continuing to pump money into Russia's war machine because not doing so would drive up their heating bills... Olaf Scholz (German chancellor) gave a speech on this a few days ago which didn't announce any changes to oil and gas imports but was mostly self-congratulatory about what a good job they've been doing.
