Not too sure if this is the right forum for this.. But anyway..

Ok so when I purchased my Nexus 7 from Dick Smith, there was a big banner on their website saying "free $25 Google Play credit with Nexus 7" and a lot of info about all the movies/ebooks/etc we can download. I took a screenshot at the time.. just in case.

Obviously they didn't do their research, because we all know that we don't get the credit and can't access any of the cool stuff from Google Play.

I e-mailed Dick Smith last week explaining the situation and politely (and subtly) asked them to honor their claim with $25 of store credit or something similar.

Haven't had a reply yet. My question is, what rights do I have? I want to get the $25 out of them to make a point. The consumer guarantees act says "Goods must match their description" and "match the description given in advertisements or sales brochures, or by the sales assistant."

Surely the lack of $25 credit is a breach of this?

Should I e-mail again quoting the act?

Also, I urge any others that purchased their Nexus 7 from DSE to do the same.

Give them a ring tomorrow? As high up as you can go. I wouldn't want to go waving around any flag until your sure they actually aren't going to give you the goods.

I too had this, I have emailed them several times and also called them twice.  I have found a contact who was suppose to help me out, they have not yet.  I will continue to follow up.  I have a screen shot, so I will get this out of them.

I know it's only $25 but as I said, I want to make a point. I know of a few people who bought the tablet and went back into store to find out about the credit. None of the staff had a clue what they were talking about.

A chain as big at Dick Smith should be a bit more careful when making claims like that then pulling them down without any explanation.

You are right, they shouldn't say something then do another, although it doesn't surprise me that the staff didn't quite know.

I was the one that rang them up (after emailing them and leaving an answer on the questions which was rejected).

The call was answered by someone in OZ and I had to explain that NZ did not get the credit/movie, they said we did, I said no as a friend did not get the "pre-loaded" movie or the credit and I did not get it as well.
They then said they would talk to their "product team" and would get back to me, within an hour the bonus was removed from the website and no reply from them.



They still have it wrong as well

I had a similar situation with DickSmith before, when I got something that has a price tag of $49.99 and when I took it to pay for it, they scanned it and said "oh, it's the wrong tag, this is $79.99" and when the guy showed me the correct tag, I found out that it doesn't match the product title or description.

Anyway, I stood my ground and asked for an explanation, so they instead of explaining it, offered to give it to me with the same (wrong) price tag on it. So I got it finally for $49.99.

The situation went smoothly, and there was no need to do anything, the sales person talked to the manager and then everything then went very nice and smooth.

Hrmm well I gave them a call, no one had any clue what I was on about and they were extremely unhelpful. And I still haven't had a reply to my initial e-mail that I sent last Friday.

Seriously the customer service is non-existent..

I got my credit, had to wipe the device and connect it to a proxy in the states to do it.

Regardless, you can forget about getting the free movie etc as it's just too hard to do (plus it's only that awful transformers 3 movie anyway). If they'd done a little basic research they should've seen that NZ is exempt as it's not an official sales region.

They're pretty obviously in the wrong, what their liabilities are under the law, I wouldn't have a clue. I doubt the amount of time it'd take to get them to sort it out would be worth $25 of my time.

Although, it's US$25 so more like NZ$30 ;)

Similar to the Sony S Tablet, the only way I could access the PS games and new android firmware was root the device and change it's region to US. They still shouldn't offer it without the backup to actually give it to people however.
