I recently signed up with Voyager on a VDSL plan.  I did the whole check that it was available thing and sure enough it was.  Now installed and the data rate is a crappy 10mbps down and 4 up.  The down attenuation is 15.5db.  The tech came back and checked that it wasn't my house wiring, turns out that it is their cabling from the cabinet that is too long.  I rang Voyager and they're saying that it is probably within Chorus's range for acceptable VDSL.  It's going to cost me $295 to get out of this toxic situation.
Does anyone have any advice?  If I were to take Chorus to the Disputes Tribunal would I have a chance of getting that contract breaking fee back.
It looks like Chorus have increased their limits on what they class as borderline or unacceptable installation criteria.
Any comments or help welcome.

Disputes Tribunal? Working broadband in spec

Consider yourself lucky you are not connected to a Conklin cabinet, These end users would love to swap with you and maybe give up first child for it

I guess what you find acceptable to take money for and what I as a customer except are totally different.
Coming from a property had 38Mbps down and 10Mbps up I'd say I've got every right to spit the dummy at Chorus.

@woollettg You don't have a right to spit the dummy at Chorus actually as they don't control the law of physics and where you chose to move to, It's a technology limitation the longer the run of copper from the serving cabinet / exchange to your house the speed will degrade

Edit: You can request to move back to ADSL2+ but then your uplink speed will be under 1Mbp/s and your download speed might increase a bit

VDSL2 like all copper products is a best effort service with no minimum service requirements.

You have no relationship with Chorus so going to the disputes tribunal would IMHO simply be wasting $40. Your issue is with Voyager.

Copper is a best effort service so you'll notice the major ISPs don't actually advertise how fast you get. Since they don't advertise how fast the connection will be you probably have no chance to sue them for anything.

As Voyager isn't charging you anything extra for VDSL you might as well think of this as ADSL with a free bonus 4Mbps upload.

A speed of less than 15/5Mbps used to be considered the cut-off point for "acceptable" VDSL speed.

A year ago I attempted to upgrade from ADSL to VDSL - got 12/3Mbps despite a full proper VDSL install with master filter and a dedicated new Cat6 cable / jackpoint.

Orcon allowed me to go back to ADSL without penalty - no push-back or arguments.

EDIT:  At the time VDSL was considerably more expensive than ADSL, so going back to ADSL was a no-brainer.

If Voyager promised you a certain VDSL speed at the new address then you have an issue with your ISP not Chorus if not then really you don't have a leg to stand on with Voyager

1.' Most isp allow you to go back to adsl free. That's the risk when you go with a small isp.

2. 4 up is 4-5x higher than adsl2's up.

So in theory your broadband is for times better. Ish. Does it cost more to go vdsl vs adsl? If not there is no problem.

They have the information with which to tell me how good or bad it's likely to be. They would have (as the chorus guy said) know where the poor areas are. I don't. Had I known that the attenuation was going to be that bad I would never have signed up.

They get that INFO from Chorus and what other options have you got to get Internet delivered to your address? Hope you don't tell us Fibre

Not I don't have the option for fibre for another 2 years. Could do Vodafone cable but I have no respect for them as a provider. Johnr. Do they still route city link traffic via the States? That's why I ditched Telstra clear...

Cable HFC network has gone thru a major upgrade and more coming and 1Gbp/s downlink coming by middle of 2016 not sure about routing I am sure someone could check who is on Geekzone
