I received this text today

"You qualify to access unlimited TV shows and movies on demand with NEON! We just need to know if you are already signed up to NEON so we can send you the correct code. Pls reply Y or N"

Note only the company name of Neon is given in the SMS message.

Only when I replied "stop", did I realize it was 2 Degrees, my cell-phone provider, not Neon.

And this is not the first time I've received opt-out texts from TwoDegrees.

When it first happened some months ago, I called their help desk and made it clear to remove me from all text spam. I made a formal complaint to the DIA, by forwarding the text via 7726.

On the 2Degrees website, there's mention of how to not get spam "opt-out" text messages. There's two options: sending a "stop" to 222, and under my account preferences I unselected "text" as a communication means.

Then as now, I did both.

By the way, texting 222 to stop future texts is clearly "opt-out" marketing, which is illegal in New Zealand.

For the second time, I called the helpdesk. They informed me that the "text" option is ignored for marketing emails. (What???)

I asked to speak to the supervisor. Reina first repeated that texting 222 was the only way, and then backtracked. She did a search of her 2Degrees own website which contradicted her.

However she insisted the only way to opt-out now was to send a "stop" message to "222" (again "opt-out" is illegal)

She promised that sometime in the future TwoDegrees would fix the account preferences, so the account settings would actually be used.

It's annoying when New Zealand telecommunication company wilfully ignore New Zealand laws, the Unsolicited Electronic Messages Act 2007.

Given you have stated that this is 2Degrees doing it and your rant is about 2Degrees I don't understand why you have posted it in the 'Sky, Neon and IGLOO' forum!???

Yes Neon may be free for 3 months, but I can't even find Neon / 2 degrees terms and conditions.


As mentioned, the text didn't have any company name except Neon

Hmmm - seems that I should have been sent a text with a promo code (as I am eligible for the offer) but haven't!! I need to contact 2Degrees as I want them to text me!!!

Two degrees probably get a commission for promoting Neon (duh)

"2.2 We may pay our Third Party Suppliers a commission in relation to the promotion of the NEON Service."

From what I see on Neon's terms and conditions, a lot of complexity is added in cancelling because of the third party (2Degrees)

"5.3 Cancelling via your Third Party Supplier: If you receive the NEON Service under or pursuant to an arrangement with a Third Party Supplier, then your ability to cancel, when cancellation takes effect, and who you must notify of cancellation will depend on the terms that apply to your arrangement with the Third Party Supplier."

"2.1 If you receive the NEON Service under or pursuant to an arrangement with a third party (eg your internet or mobile service provider) ("Third Party Supplier") then different or additional terms (including relating to cancellation, fees, payment, billing arrangements and what happens to your subscription to the NEON Service on cancellation or expiry of your arrangement with the Third Party Supplier) may apply, and those terms will take precedence over these terms. Please refer to your Third Party Supplier for further details."

I'm not using Neon, because they are associated with Sky, but something others may want to be aware of.
