Hey all,

 

TLDR: Bought a car with issues, It never went into my name, Car dealer has taken it back, Waiting for my money.

 

So its been a while since i have been on here. Im back in the IT sector once again and working for a cool kiwi company doing big things offshore and here.

 

Now i bought a VW passat from a car dealer 2 months ago. Good car, NZ new, 4Motion, tow bar etc. Ticked all the boxes.
About a week after purchase the engine light came on, Spoke to the dealer and due to the warranty they provide he said for me to get a quote from a local mechanic as he is out of Auckland.
Which i did at my own cost. Turned out to be too costly and we didnt want to get it done there. I explored second hand options and found my Fathers mechanic can do the Cats for $600!

 

Excellent i had my car on it way to being fixed. 

 

On the day i got to drive it up north 08/10/16 (Whangarei) to be fixed disaster struck. The front coolant housing split at the same time as the heater core. Great the car was off the road (2 weeks ago now).
After letting the car dealer know this we looked at getting that fixed as well, Turned out to be too costly and he agreed to take the car back and fix and resell (Due to the fact i got the car nearly at his cost)

 

So it sat at my mechanics last week until yesterday when his tow truck arrived to get the car. Unfortunately i couldnt be there or hold the car at my residential address so had to be handled by my mechanic.
He said on the 17th (Yesterday) that the truck was booked (Which it was) and that the purchase amount will be refunded.
So its only been a day since then and no funds have cleared and the car is gone.

 

Now i cancelled my insurance last night and they advised me something quite interesting.

 

The car was actually never put into my name, It remained in the car dealers name the whole time. Now the forms he must not have processed at all. I remember handing forms in at the post office for this.
Now that is what worries me, As a LMVD you can see the current owners etc. I tried to find the signed (By both parties) purchase agreement but in my multiple house moves in the last 3 weeks its probably missing.

 

Am i being cynical here or could i be in for a ride?

 

 

 

I will wait for another 24 hours for payment before i go to the next step. Maybe you guys can help me with past experiences or anything that could help me here.

I would just go in and talk to them.  PITA to do but you will soon get a read on whether they are giving you the run around.

 

Did you get receipt and/or sale and purchase agreement when you bought the car? 

 

If yes then the official govt paperwork isn't critical. Although not filing for two months is rather unprofessional, should have been done in day or two.

I agree myself, Illegal and unprofessional. I cant find the Purchase and Sale agreement with both parties signatures on it.
The system is there so if one side of the agreement doesnt get processed like my case the other one does. I just hope it doesn't add to the complication of things.

 

 

 

He is all co operative on the phone but never reply's to written forms of communication. Wish i could call record but you dont get that feature on Samsungs flagship S6 Edge+ device.

Do you remember what paperwork you handed in to the Post Shop? The MR13B form would've required you to show ID and pay a fee of $9. This will then have the car registered in your name.

 

The trader can also do this for you, provided they have your ID and have agreed to do so on your behalf.

Yep, He took my drivers licence, Address and everything else, We both got a copy of the form. It had the sale amount his and my signature. The form had all my and his details on it. It wasnt the MR13B it was a blue form. Believe it was just a binding document a trader uses to complete a sale. I am sure that i did complete the form in a post office. At the time i was handling multiple car sales and may have stuffed it up. I do recall the trader did say to me he will process it as well to make sure it went through. 

 

I probably did bugger it up as it probably would be in my name haha..

 

I used the website to let NZTA know i sold/disposed of the vehicle back to the LMVD. Ill call them at lunch to see if i can get my ownership backdated.

I also tried to contact the car dealer this morning with no success. Hmmm...

Backdating won't affect ownership."Registration is not legal title for the ownership of your vehicle. It simply identifies who is responsible for the licensing and safety inspections of the vehicle."

 

 

 

When you use a credit card for deposits on rentals etc a simple reversal can take a few days to appear back on your account. Given the benefit of doubt you may have to wait more than a day.

Yeah, we have been giving him the benefit of the doubt for the last 4 weeks. Even didnt disturb him while he was on holiday over seas.

 


Things just dont add up, On Sunday "The wife will put it through now" Monday came around and nothing, today and no money or reply to sent messages so we gave him a call.
Said his wife put it through Monday (Yesterday).. He is ANZ and im ASB, We transfer from an ANZ account to my personal ASB all the time and the processing times seem to be every 6-12 hours. 

 

Things smell fishy and it seems like the good ol run around.

 

I called NZTA and like you said @Bung, It reflects the person responsible. She said that he didnt put it into his own dealership name and until now it remains in limbo.

 

I feel like it is a little hasty but im walking to work 3KM away each way every day rain hail shine, Have no form of transport or money to pay for an alternate means so, Been like this for the last 3 weeks but luckily family lent me a car for a short period last week when it was raining. So im pretty fookd until i get my money back then i have to endeavor finding a new car.

Well, I dont know what is going on here, But for some strange reason i just got 2 separate payments of $1000 from the LMVD. Still $2500 short of the sale price.

 

Beyond me?!?!

Probably the limit they can pay each day or something and they dont want to have to deal with the bank to be able to pay more?

 

See what happens tomorrow but remember that CGA covers you for consequential damages so tell them that if you dont get it all ASAP you will have to go after them for car hire costs.

Yeah i should have hired a car 3 weeks ago and pinned it on them but i made an effort to be as civil as i could and just try get it sorted without the courts.
I would assume they have an individual transaction limit of $1000 or something.
Weird but will just see how it goes over the next day. 


 

 

 

**Update, Its all there now. Must have been a limit of a $1000 a day..... Never knew we could have 5 days in one.

Being Civil is part of a relationship so I think you've handled it fine. There are sometimes things that happen to people, that aren't the fault of the person affected, that a little patience resolves :) 

 

I think at the end of the day, despite the fact communication and resolution time have been less than ideal, you have a decent outcome, Sht happens even with the best of intentions.

This.

Rego has nothing to do with ownership.

Not sure how one can identify the owner except where there is an financial interest (eg money is owing).

Since we dont have the idea of ownership papers here like many other countries, you cant really ID the actual owner.

I did learn a lot from this experience..

 

Firstly it would be to make sure a trusted mechanic does a thorough inspection for you.
Secondly if you have any issues pop up in the warranty period just get rid of the car, The mistake i made was not asking for a refund when the initial problem occurred, It was talked about but i liked the car and wanted to keep it.
Third, Make sure you get the forms processed as soon as possible and dont rely on the other party to complete it, Also do a followup if you dont get the letter in the post.

 

It is quite interesting about registration and vehicle ownership but thats a good topic for another day.

 

Anyway, I think the outcome was good, It was delayed but i saw the money returned in full. Being as co operative as you can is the best idea, The car dealers can easily make your life a whole lot more difficult if they want to.
