7. CANCELLATION OF ORDERS

7.1 JB Hi-Fi reserves the right to cancel, at any time before delivery and for whatever reason, an Order that it has previously accepted. JB Hi-Fi may do this for example, but without limitation, where:

(c) Goods ordered were subject to an error on the Website, for example, in relation to a description, price or image, which was not discovered prior to the Order being accepted;



The way I see the order has been accepted once the credit card has been charged, I would agree that either party could cancel the order before the payment was authorised.

And at the end of the day a company cannot contract out of the law, doesn't really matter what the T&C's are, if they don't align with the law they don't apply.

floydbloke: I'm not sure whether to admire the tenacity or roll my eyes at those who are prepared to fight tooth and nail.

Personally, I ordered because it would have been a great deal if it were genuine.  Turns out it wasn't, someone made a booboo (system error - you can argue people form part of the 'system').  JB Hifi appear to be acting within the law, cancelling my orders making sure I'm not out of pocket and an apology for inconvenience caused.  Case closed as far as I'm concerned.  I don't think any less of JB Hifi because of it.

Consider if you made a mistake at work that could cost the company you're working for (tens of) thousands of dollars.  How would you feel?  Do you think the company should wear that loss even if it was completely within its rights to avoid it. 


Totally agree. I am just doing it for amusement more than anything. I won't be pursuing it further.

yep mine cancelled now too. Shall now carry on with my day. And the search to replace a dead laptop in the interim. Group hug smile

yes I just got the email everyone else is getting too

makes me wonder why JB didn't make an opportunity of it e.g. we kindly offer you one item up to a value of $500 at cost price or something or discount etc

Thanks. I am sure you can classify this as bait advertising. There was a lot of time wasted and money kept for over 48 hours irrespective of their terms.

Interesting the page is now saying "the offer has now expired" instead of going to the actual product. This seems to indicated it was an offer at some point. Or just bad choice of words, or just bad system.

I think Hanlon's Razor apply here: "Never attribute to malice that which is adequately explained by stupidity."

Exactly!

Does this not acknowledge that there was in fact a deal(see previous screen) which has now ended?

The response to this and exceptionally poorly written letter is nothing but a disaster from JB HiFi - and that's being kind to them.

Any retailer is well within their rights to not sell a product because of a mistake, and their terms and conditions along with the FTA make that very clear. I expected when I ordered the product that this would happen.

The way this has been handled on the other hand is very different - the letter they sent out should have essentially said "we made a stuff up and had this at the wrong price. sorry". It didn't. Who possibly knows what a "porting error" is? There is no mention that the price was actually wrong, simply that they've cancelled the order.
