Exactly. As long as jail time is less then 12 months, you just need a visa.

Not a lawyer, no special knowledge, not qualified to comment, but of course I will anyway, at least to make a general point. I have been astonished in the past by a few judgely decisions similar to this one that seemed completely off the planet. In those cases it really did strongly appear that the judge was completely away with the fairies, totally seduced by the wealth or social standing of the defendant or the defendant's family, had no concept of the law at all, and clearly didn't care what anyone thought anyway. Justice is supposed to be blind and judges are supposed to have a duty to be impartial, and I can only say that there must still be some relics from another era on the benches here who think some people are more equal than others. Judges who base their judgements on class or occupation are a disgrace in my opinion. If someone wants to have an illustrious career as a Rugby player or anything else, they shouldn't go around assaulting people. I agree wholeheartedly that there should be second chances for people who make dumb mistakes that might otherwise scar their lives forever, but aggressive assault crosses the line for me.

Interesting that John Key mentioned the Solicitor-General when he was aksed about the issue when it broke. Maybe have been a hint that it doesnt end here

This has only happened because of public pressure though. If nothing had of been said or this had not been bought to light then nothing would have happened.

I was always told at 17 you are an adult in terms of criminal charges.

 

Oldest age for Youth Court is 16

Wow, I was shocked.


Its a fair point to say that his sport situation causes the punishment to exceed what Joe Average would have got. That's understandable


So, make the punishment avoid the effect on his sports, but use another form of punishment. 150 hours community service for what he did, the guy was laid up in hospital for ages, hasn't worked for 8 months.


1500 Hours community work, at a minimum of 25 hours per week


Reparation of every cents its cost the victims in lost wages, i.e. the 20% that ACC doesnt pay.


Compensation at say $5k for the guy and some for the girls.


Its also fair to say that this is a serious crime, and too freaking bad if you think you can do that and walk away. If it was a silly drunken punch then assess that but this was bad. I see he's been sacked, so maybe he can have a sentence that wont affect his career??


 



I wonder why they would be covered by ACC for lost wages, because it wasn't an accident. In fact acc don't cover illness, which is usually no different from an accident in terms of it being caused by bad luck. i think it is good that at least someone is covering their lost wages, but should it be acc and people who pay into acc, eg taxpayers, paying for it. If you get some sort of illness that stops you working, you don't get this type of cover.

At least it looks like the police are appealing the conviction. It is amazing how the weight of public opinion has so much power.

Although that is democracy. It is exactly why we need strong media in Nz. If we didn't we wouldn't have even known about this case. But there are probably many things that go on in nz that are not covered by the media and would be as deserving to be brought to light. Is suspect this one made headlines because it involved rugby and some people see double standards occurring.

This will annoy a few people but it's been proven that jail time is not constructive and young males frequently make the odd poor decision for which they shouldn't automatically be jailed for as this will actually just turn them into hardened crims. It's proven better to chalk up their first mistake as a learning experience for them. Repeat offenses of course show another story however and should be treated differently.

In this case I do wonder if it would have had a different outcome should he have lost the contract before the court sentence.

No doubt if he makes another mistake the court won't be so lenient.
