The New York Times - Justice Ruth Bader Ginsburg Dies at 87

I'm sure Trump will have the same grace and dignity as Obama, and allow the next president to select the Supreme Court Justice.

There's no way he would try to rush in to get another conservative justice in place before the election, right :(

So I guess 2020 the year that sucks may become 2020's the decade that suck.

The one saving grace is we live in New Zealand.

freitasm:

This is an interesting article. I won't even quote here as it is important to read the whole thing to get the context: "Dear news media, stop covering the US as if it’s a democracy"

In a way, it supports @Nathan's statements that Trump is not the problem but a consequence, but without the disbelievable theories.

What an impressive article. It could make you weep for America and the world.

What is America doing to itself? Powerlessness is a a very bad feeling.

I despair.

Fred99:

Well they should be punished by the electorate if they do, and they should understand that's the consequence.

Clearly there are no consequences, because you have no choice, because you're either voting or you're not, and they know it.  Its gamesmanship, a toxic blood sport.  They don't represent us - they win regardless.

Democracy dies in darkness.  Do people actually vote on principles - or is it like being a fan of a sport team?

Two serious mistakes by Dems. RBG should have probably resigned / retired during Obama's reign, and Obama should have never used the "nuclear option".

No it seems most don't.  They don't vote on principles or even for policies, just mostly along tribal lines

"a division of the republic into two great parties … is to be dreaded as the great political evil.”

Once Obama opened that bottle, the genie can't be put back into it.

CNBC: Trump wants to move ‘without delay’ to replace Ginsburg, setting up epic Supreme Court fight before election

Senate Majority Leader Mitch McConnell on Friday pledged he will hold a vote on Trump's eventual nominee to fill the vacancy.

The Supreme Court had a 5-4 majority of Republican appointed justices.

A 6-3 GOP majority could transform the shape of the law and maintain a conservative majority for years.

The vacant seat on the court raises the stakes in the presidential contest between Trump and former Vice President Joseph Biden.

...Trump, in a social media post, wrote that Republicans "were put in this position of power and importance to make decisions for the people who so proudly elected us, the most important of which has long been considered to be the selection of United States Supreme Court Justices. We have this obligation, without delay!"

The president's statement follows Ginsburg's death on Friday evening.

Trump is expected to quickly name a conservative replacement. Only an hour after the Supreme Court announced Ginsburg's death, Senate Majority Leader Mitch McConnell on Friday pledged he will hold a vote on Trump's eventual nominee to fill the vacancy. McConnell said last year he would seek to confirm a Trump nominee if a vacancy opened, despite vowing during President Barack Obama's presidency to refuse any appointments during an election year. ...

just changed the election from a referendum on Trump and the plague, to one on whoever he wants to nominate to the Supreme Court.  Its hard to see how this doesn't help Trumps re-election chances.

Obama didn't "allow the next president to select the Supreme Court Justice". Obama's nominations were blocked for nine months by the Republican-controlled Senate, with Mitch McConnell saying it's wrong to have a nomination that close (nine months) to a Presidential election... Oh, the irony.

Today's quote   "I think you ought to know I'm feeling very depressed."  Marvin, The Hitchikers Guide to the Galaxy

The New York Times - How Mitch McConnell Can Quickly Push Through Trump’s Supreme Court Nominee

today (extracts only)

The rules and partisan breakdown of the Senate make it possible for Republicans to swiftly confirm President Trump’s Supreme Court nominee.

  • Can Democrats block Trump’s nominee through a filibuster?    No.

  • Does McConnell have the votes to confirm a nominee?    It depends.

  • What if Republicans lose the White House, the Senate or both? Could they still confirm Trump’s nominee after the election?     Yes.

... even if Mr. Biden won the presidency and Democrats secured control of the Senate, Mr. McConnell would remain majority leader for the remainder of the year, with the ability to force votes provided that he maintained the support of a simple majority. ...

from the same article:

For many Republicans, the ideal situation might be to begin the confirmation process quickly, injecting it into the political bloodstream but waiting until after Election Day - when vulnerable incumbents no longer have to worry about being cast out by angry voters - to hold a confirmation vote.

Ginsberg was not a member of either party to my knowledge. Either way like any supreme court judge it was her choice and not the choice of any political party.

She was highly principled, taking the long view in her judgments, but obviously not the long view on her mortality.

I can't say lacked political thinking, but like a lot of old people, simply didn't give a f__k.

She didn't belong to any political party, but she was definitely liberal, and often ran at odds with Republicans.

I'd hope this would galvanize the liberals / democrats / women.

There's a real chance abortions will become very strict, bordering on illegal, if another conservative justice is appointed.

65% of Americans 18-29 are pro-Choice, but this demographic doesn't have a high voter turnout. Come on kids. Get your asses out to vote. You've got more to lose.

37% of 65 or older are pro-Choice, and usually always vote.

However regarding over 65's, there's a double whammy of Trump trying to keep mail-ins voters down, plus old people worried they'll catch COVID if they go vote in person.

Perhaps this is the year over 65's won't vote as much, thus making Biden's job easier.

And meaning Biden will appoint the Supreme Court justice.

Its interesting because Obama even choose a pretty right nomination in Merrick Garland, he was either a Centrist who didn't care about challenging the Republicans or naïve in not being Nasty enough like McConnell was/is multiple times

The Washington Post - Nine implications of Ruth Bader Ginsburg’s death

today

headings only

  1. Trump will probably nominate a woman in the next few days.

  2. A Senate vote on Trump’s nominee seems most likely to occur during the lame-duck session, after the election.

  3. This vacancy gives Trump the opportunity to reframe the presidential race away from the coronavirus.

  4. This vacancy will drive up turnout and energy on both sides, but it could wind up motivating the right more than the left.

  5. This vacancy makes ticket splitting less likely in November, increasing the odds that Republicans hold the Senate.

  6. Few Republican senators will care about being charged with rank hypocrisy.

  7. There will be immense pressure from the left for Democrats to pack the Supreme Court if they win the Senate majority.

  8. The coming fight will further erode public confidence in the neutrality and independence of the courts.

  9. Chief Justice John G. Roberts Jr. will no longer be the swing vote.

and, letting another genie out of the bottle, by adding additional Supreme Court seats, which would first require gutting the filibuster
