A Manhattan jury on Tuesday found former President Donald J. Trump liable for the sexual abuse of the magazine writer E. Jean Carroll in a widely watched civil trial that sought to apply the accountability of the #MeToo era to a dominant political figure.

 

The federal jury of six men and three women took only three hours before returning a verdict.

 

They also held Mr. Trump, 76, liable for defaming Ms. Carroll when he posted a statement on his Truth Social website in October, calling her case “a complete con job” and “a Hoax and a lie.”

 

Although more than a dozen women have accused Mr. Trump of sexual misconduct over the years, Ms. Carroll’s case is the first claim to be successfully tested before a jury.

 

The jury determined that Carroll had proven Mr. Trump sexually abused her, but they rejected the accusation that she had been raped.

 

Sexual abuse is defined in New York as subjecting someone to sexual contact without their consent. Rape is defined as sexual intercourse without consent.

 

The jury awarded Ms. Carroll, 79, a total of $5 million in damages.

 

The jury’s unanimous verdict came in Federal District Court in lower Manhattan. Its findings are civil, not criminal, meaning Mr. Trump has not been convicted of any crime and faces no prison time.

 

Jury also found that Mr. Carroll proved, by a preponderance of the evidence, that Ms. Carroll was injured as a result of Trump’s publication of his denial of her accusations on his Truth Social account in October 2022.

 

The jury determined that Ms. Carroll had proved, by clear and convincing evidence, that Mr. Trump knew his statement was false when he said her accusation was a hoax, a legal standard known as “actual malice.”

Fox News: Trump to appeal verdict in E Jean Carroll civil case, says he has 'absolutely no idea' who she is

Former President Donald Trump told Fox News Digital that he will appeal the ruling in the E. Jean Carroll civil case, saying he has "absolutely no idea" who she is while blasting the verdict as a "disgrace" and "a continuation of the greatest political witch hunt in history."

A federal jury in New York City decided Tuesday that Trump was not liable for rape but was liable for sexual abuse and defamation. The former president has been ordered to pay $5 million.

In an exclusive interview just after the jury delivered the verdict, Trump told Fox News Digital that he has "absolutely no idea who this woman is."

"This verdict is a disgrace," he told Fox News Digital. "It is a continuation of the greatest political witch hunt in history."

Trump told Fox News Digital that he "will appeal."

"We'll appeal. We got treated very badly by the Clinton-appointed judge," Trump said. "And [Carroll] is a Clinton person, too."

He added, "I have no idea who this woman is."

Carroll, 79, alleged that Trump raped her at the Bergdorf Goodman department store across the street from Trump Tower in Manhattan sometime in 1996. According to Carroll, the two had a chance run-in at the store, where Trump was shopping for a gift for "a girl." She said he asked for her advice, and the two shopped together before he pushed her into a dressing room and assaulted her. Trump and his legal team insist that Carroll's allegations are fabricated, with the former president's initial reaction including an accusation that Carroll was motivated by wanting to sell copies of her book.

That denial resulted in Carroll slapping Trump with a defamation claim, claiming that his response caused harm to her reputation.

"I filed this lawsuit against Donald Trump to clear my name and to get my life back," Carroll said in a statement. "Today, the world finally knows the truth. This victory is not just for me but for every woman who has suffered because she was not believed."

Carroll's lawsuit requested compensatory and punitive damages as well as an order that Trump retract his statement.

Trump's presidential campaign released a statement that said the Democrats' "witch hunt" had reached a "new low," calling it an "abuse of our great Constitution."

"In jurisdictions wholly controlled by the Democratic Party our nation’s justice system is now compromised by extremist left-wing politics. We have allowed false and totally made-up claims from troubled individuals to interfere with our elections, doing great damage," the statement said.

"Make no mistake, this entire bogus case is a political endeavor targeting President Trump because he is now an overwhelming front-runner to be once again elected President of the United States."

That's a common thing of his I've noticed when Trump's boxed into a corner - he trots out the line of "I don't know this person" or "I barely know this person", never mind the photographic evidence that proves it 🙄

OAN, "One America News Network", is a right-wing news outlet.

One correspondent called for the mass execution of election officials, another used a racial slur on air without consequence, and a third who suggested shooting of the homeless.

It is beloved by former President Donald Trump. The channel came under fire for spreading misinformation about COVID-19, the 2020 presidential election and the Jan. 6 attack on the US Capitol.

One of their former employees is serving as Trump's aide.

Voting machine maker Smartmatic served former President Donald Trump’s lawyer and onetime One America News talking head Christina Bobb with a subpoena for documents that the company seeks over their multi-billion dollar defamation claims against Fox News related to the 2020 presidential election.

I just googled the entire site for any mention of Carroll, the sexual abuse victim. Never mentioned, of course.

The kind of people who adore Trump will probably see this verdict as some sort of twisted badge of achievement, in the sense that he did something most of them would not have a problem with and many would probably like to do.

New York Times: New York law gave jurors three types of battery to consider in the Trump case.

Judge Lewis A. Kaplan on Monday morning walked jurors through a verdict form, explaining what battery meant in the context of a civil lawsuit and that there were gradations of that wrongful act.

He offered three types of battery for which Mr. Trump might be liable under New York law:
  • rape
  • sexual abuse
  • forcible touching.
To find that Mr. Trump raped Ms. Carroll, the jurors needed to believe that it was more likely than not that Mr. Trump engaged in sexual intercourse by physical force....

To find that Mr. Trump sexually abused Ms. Carroll, the jurors needed to believe that Mr. Trump subjected Ms. Carroll to sexual contact by physical force....

Forcible touching, the judge said, “includes squeezing, grabbing, pinching, rubbing or other bodily contact that involves the application of some level of pressure to the victim’s sexual or intimate parts.”
