Two pages of a document briefly posted and then taken down from the Fulton County, Georgia official court website shows a list of 13 potential felony charges against former President Donald Trump, after being downloaded by Reuters, shortly before the court took it back down without explanation, in Atlanta, Georgia, U.S. August 14, 2023. 

 


Aug 14 (Reuters) - The Fulton County, Georgia, court's website briefly posted a document on Monday listing several criminal charges against former U.S. President Donald Trump that appeared related to his attempts to overturn his 2020 election defeat in the state, before taking the document down without explanation. ...

 

The two-page document cites the "Violation Of The Georgia RICO (Racketeer Influenced And Corrupt Organizations) Act," "Solicitation Of Violation Of Oath By Public Officer," "Conspiracy To Commit False Statements and Writings" and "Conspiracy To Commit Forgery in the First Degree," among other charges listed.

I wonder. But is he bright enough to plan this and carry it out over a prolonged time (like a couple of weeks!)?

 

I just don't know. Previously he has always had the legal idiots to do the planning. But, maybe he has another set of legal idiots???

 

In the end, I think the US has to stand up to him and jail him even if it creates riots. You can't keep saying no one is above the law

 

then show that that is a lie.

 

We live in interesting times.

RICO! With Trump's bestest and big brains, this one should make him wipe his brow with his red tie.

Reason #1: It's less serious than murder, but in the same ballpark.

"Racketeer Influenced and Corrupt Organizations Act" RICO

It is usually used in reference to patterns of illegal activity

It sounds like Georgia has their own version of this Federal crime.

Reason #2: Note that President Biden cannot pardon state crimes, even if he wanted. The Georgia Governor could BUT the prisoner must have exceeded the minimum sentence. It's not unusual for a RICO sentence to be 20 years, with a minimum sentence of 3 years.

So even if the Georgia Governor was a Trump fanboy, Trump would likely spend at least a year in prison before he could be pardon.

There's no shortage of crazy in the US, but the feds are now taking any insurrection more seriously than in 2021.

Currently about 700 defendants had been found guilty (most by pleading guilty, the rest convicted at trial), and over 550 of them had been sentenced. Hundreds were still awaiting trial or sentencing.

While there's many who jail holds no fear, many enjoy living in their parent's attic, and eating McDonald's Double Quarter Pounder with Cheese and Burger King Quad Stacker.

The Washington Post - The 5-Minute Fix - The RICO Act

 


Any day now, Trump and his allies could soon be facing allegations in Georgia of a serious crime - racketeering - in connection with their efforts to overturn that state’s election results in 2020.

 

The law that might be used is the Racketeer Influenced and Corrupt Organizations (RICO) Act. 

 

RICO allows prosecutors to weave together several alleged crimes into one racketeering charge that calls for up to 20 years in prison.  The law is designed to prosecute a criminal enterprise.

 

So this could be applied, legal experts theorize, to the collection of lawyers, political operatives and Republican legislators who tried to overturn the results in Georgia, allegedly at Trump’s behest. ...

 

Georgia’s racketeering law is one of the broadest in the nation.

 

It allows prosecutors to weave together a wide variety of alleged crimes, including violations of state and federal laws - and even activities in other states. To make a racketeering case, prosecutors need at least two underlying potential crimes in the furtherance of an enterprise.

 

The law does not require a defendant to set foot in Georgia to be charged.

 

 

Fani Willis, the top prosecutor for Fulton County, Georgia, was recently quoted as saying: “I have right now more RICO indictments in the last 18 months, 20 months, than were probably done in the last 10 years out of this office.”

RICO is really nasty, that's by far the least pleasant thing in that entire list to be charged with. Also a slightly surprising charge given that it usually involves crimes for financial gain. It also allows the government almost unlimited power to seize assets (something which has been appallingly misused in the past), so maybe they're using the threat of that to intimidate him, seize all his PAC funds?

I think it is poetically appropriate that Trump is likely being charged under an act that was designed for organised crime (read 'the Mafia'). If ever there was a Don in all but name (well, including name), it is he.
