The Daily Beast: Inside One ‘Egregious’ Mistake From Trump’s Florida Judge Aileen Cannon

U.S. District Judge Aileen Cannon, whose pro-Trump bias and head-turning errors have raised questions about whether she should be overseeing former President Donald Trump’s criminal trial in Florida, made what appears to be another surprising mistake last year.

Now, a defense lawyer is seizing on her misstep to try freeing his client from prison—even though he was caught on tape violently throwing a courtroom chair at a prosecutor and threatening to kill him.

The blunder was simple and entirely avoidable. The federal judge told jurors they could find the man, Christopher Wilkins, “guilty or not guilty.” But then she handed jurors a verdict form that didn’t even have those options.

“How far does somebody have to go to school to say that a verdict form is supposed to say guilty and not guilty?” asked defense lawyer Jeffrey Garland. “That would be one of the more egregious versions of jury instruction error… it’s such a rare error.”

Cannon’s short and controversial history on the bench is under a microscope, given that she is presiding over such an historic criminal trial: that of a former president facing prison time for mishandling classified records at Mar-a-Lago and lying to the feds in a coverup. Trump himself appointed her in his final months in office, yet she has not recused herself from the case.

Cannon first came to people’s attention last year, when Trump’s lawyers were chastened by a judge who accused them of trying to game the judicial assignment system in a brazen attempt to have her oversee a conspiracy-laden lawsuit against political rival Hillary Clinton.

But she gained notoriety when Trump sued to block the feds from investigating Mar-a-Lago and she was oddly assigned the case, despite being in a distant corner of the district far from Trump’s mansion. Cannon immediately began to issue bizarre orders that froze the investigation—until appellate judges told her to back off. A court screwup even exposed how she was bending over backwards to appease the man who appointed her.

But now she’s come under fire over her inexperience.

Washington Post: Judge reimposes restrictions on Trump’s speech in Jan. 6 case

A federal judge has reimposed limits on former president Donald Trump’s public statements in advance of his trial on charges of conspiring to subvert the results of the 2020 election.

U.S. District Judge Tanya S. Chutkan on Sunday evening put back in place an order she had lifted nine days earlier to give Trump and U.S. prosecutors more time to argue whether the restrictions were unconstitutional

If Trump violates the gag, as he did a similar order by a state judge in New York, Chutkan will have to decide how to punish the former president and leading presidential candidate.

Under the existing order Trump and all interested parties in the case are barred from making or directing others to make public statements that “target” individual attorneys, witnesses, “any reasonably foreseeable witness,” or court staff involved in the case or the substance of their testimony.

In other cases, violators of gag orders have gone to jail, but the logistics and political implications of imprisoning a former president and current presidential candidate make that unlikely. Trump is personally furious about the gag order, advisers told The Washington Post, but his campaign sees it as a political asset; any punishment would likewise feed into Trump’s narrative that he is a victim of government persecution. In New York, the judge overseeing Trump’s civil fraud trial has fined the ex-president $15,000 for repeated comments attacking a court clerk.

The 42-year-old Klein is the first member of the Trump administration to be arrested in connection with the insurrection, which led to the former president's second impeachment and charges against over 300 people.

Of course, Trump you'll remember this comment about John McCain: "He is a war hero because he was captured. I like people who weren't captured"

So I'm pretty sure Trump doesn't care about Klein, if he ever did.

NBC news: Former Trump appointee found guilty in Jan. 6 attack on police

A former Trump-appointed State Department official was found guilty Thursday over a Jan. 6 assault on police during the U.S. Capitol riot, per multiple reports.

Driving the news: U.S. District Judge Trevor McFadden convicted Federico Klein, who also worked on Trump's 2016 campaign, after prosecutors alleged surveillance showed him trying to breach a police line to enter a Capitol tunnel with a mob of rioters.

I hate to be a party pooper - there's nothing I'd like better than to see Trump removed from the ballot in every American state. Geez, I want to see him removed from the planet. However, I don't think the court case will succeed. Check out this video in which Chris Christie explains why not, from 1m 17s to 2m 21s.

He's already going to lose, as the incumbent almost always win.

That's the problem in the US; no matter how horrible you are, you'll probably get re-elected.

Note I couldn't find the incumbent success rate in New Zealand, but I suspect it's low, which is usually a good thing.

In the US, you have to be a complete d__khead, like Trump, to lose a race.

My concern is not Biden not winning, but him keeling over during or just before the election, leaving Kamala Harris to carry the can. She might well make a fine president, but perception is everything and voters won't support her.

Much of this morning’s testimony has been centered on the idea that the Trump Organization got lower interest rates because they inflated the value of their assets on financial documents.

 

The loans they received from various lenders would have come with higher interest rates had they put more honest appraisals on various documents, the New York attorney general’s office is arguing.

 

The state hired an expert witness, Michiel McCarty, an investment banker, to calculate some of what the Trump Organization’s lenders lost out on because of the fudged financial statements. 

 

The number he calculated was just over $168m ...

In the family fraud case, the judge will come down on Donald Trump Jr like a ton of bricks.

The judge in the case has already ruled that the defendants engaged in fraud

Donald Trump Jr was asked a series of question about the roles he, his father and Allen Weisselberg had as trustees of the Donald J Trump Revocable Trust.

So far, he has said he does not recall much, including why there was a brief period in 2021 when he had resigned and then been restored onto the trust.

When asked whether his father is still a trustee of the trust, Trump Jr said, “I don’t recall”.

From a rally today. I couldn't make this one up.

The former president criticized open border policies on Saturday and claimed people were coming to America from “insane asylums” before bringing up “The Silence of the Lambs.”

“Hannibal Lecter, how great an actor was he?” said Trump in a mix-up between the fictional character’s name and Anthony Hopkins, the actor who played the cannibal in the 1991 film.

“You know why I like him? Because he said on television on one of the – ‘I love Donald Trump.’ So I love him. I love him. I love him. He said that a long time ago and once he said that, he was in my camp, I was in his camp. I don’t care if he was the worst actor, I’d say he was great to me.”

I've never seen Silence of the Lambs, but I have a feeling Anthony Hopkins probably didn't say that anywhere in the movie.
