I had considered human error during the first slamming but for it to happen again a week later seems to negate this.

cisconz: Have a quick read through this, Chorus will probably quote Principle 11 as their reason for not giving out the information. What complicates it further is who's name the new connection is in, if it is not in your name then you have little to fall back on. Hiowever if you own your house then you can cancel any service terminating to your address, if not then it is up to your landlord if it goes that far.

I would request an account number change at Telecom to prevent it happening again.

We have already had a new account a week ago when it happened the first time. Now this new account has also been slammed.

What I also can not totally understand is the inability of Telecom with regards to the original account. They had effectively wiped out over 45 year relationship with a valued customer. This is in fact, my parents account of which i have authorisation to speak for on their behalf. They own the premises bui telecom couldn't even tell me what plan they had been on

Ok heading to bed with the privacy act 1993 (might just cure the insomnia).  Will keep you updated as the drama develops.

How happy am I to have found this sight, thank you all so much geekzone rules!!!!

Don't take this the wrong way, but are you absolutely 100% sure your parents didn't signup for another provider and either didn't tell you, don't remember,or misunderstood the offer?

I'm thinking back to this other thread from a while back http://www.geekzone.co.nz/forums.asp?forumid=49&topicid=85612 where it turned out to be exactly that. i.e. the person thought they were slammed, but actually it was their housemate (who was the account holder) that had signed up to another provider.

Surely telecom can only allow people that are authorised to make changes to your account, to make those changes, and they must have mechanisms in place to police it. Sounds like you have been a victim of fraud. Perhaps you ned to lay a compliant to the police and the privacy commissioner about it, as it sounds like someone may have illegally got access to your account details.

The losing provider cannot do anything about it, so who's "authorised" is irrelevant.

Back in the days, this used to be something Slingshot did quite a bit.

Sorry all, not quite understanding this but I'm curious about it. I understand it as someone stealing your account (or in this case, becoming your toll call providor) from your legitimate provider without your consent.

If this is correct, what happens when you make a toll call? Do you get charged by a random company that you don't have an agreement with? If this happens, you'd obviously refuse to pay it and ask to see the contract which they couldn't provide. So you get free toll calls...I must have the wrong end of the stick here...

Hey nickd,  it is the broadband that has been slammed, not the phone, some other service provider has stolen our broadband from Telecom, twice now, without any authorisation from the account holder ie me, which actually leaves us without any broadband at all and as we do not know who the thieving service provider is we can not get it returned free or otherwise. Utterly utterly beyond me, because surely this would be happening all the time, Telecom would have no customers left!! I wonder if the beehive was slammed twice, whether they would change the privacy act so they could find out who the fraudster/thieves are?

Although I am disgusted by slamming, I am with NonPrayingMantis here. You are not the account holder. Are you 100% absolutely sure your parents did not sign ANYTHING AT ALL? Someone selling stuff door to door? A friend who sent them a competition link?

My mother in law (80+) at the time got conned by a telco (named above and rather aggressive phone marketing) to move to a better deal (place?). She thought they said they were Telecom and agreed - suddenly internet disappeared etc - took ages to sort out. She died last year and the ComCom is still 'investigating'.

Lets be clear here people:
Telecom is just another telco these days - they are separated from Chorus just as any other teleco - they have no 'inside' knowledge of who has taken an account etc.

Chorus own the lines and the connectivity and do the provisioning.

As a rule you cant deal with Chorus directly - they are just a supplier to telcos.

As much as you might like to you cant blame Telecom for this (unless they have stolen the account from themselves - and they would actually know if they had done that!).

plambrechtsen: Could you email me at pl at telecom dot co dot nz with all your detailed information including your account number and the affected phone number a daytime contact number such as a mobile so we can speak with you.

I would personally recommend you go to the police station and make a formal report there too.  As that way you have made a legal declaration in front of a sworn officer that this was not an authorized action.  Again this is my own personal recommendation not official telecom line.

Wouldn't the police just laugh at you?

I couldn't even get them to take the theft of my car seriously.

No.. they "should" take you seriously.  Since you're making a sworn statement in front of an officer.  If you're not telling the truth then you're breaking the law.  IANAL.. But that's what happened when I needed to make a statement many moons ago completely unrelated to anything phone related.

Cookie67: I have been speaking with a woman from Telecom based in Wellington. She is going to call me again tomorrow it to let me know if she has been able to get any information out of Chorus. She is unable to stop the slamming that is booked in tomorrow from happening so I find it unlikely she will have much luck there. I have emails ready to send to the Commerce Commission, Fair Go, the Privacy Commissioner and if all else fails, then will call the Police as a fraud has been committed and surely the privacy act breached. Ha so much for an early night!

Would make a good fair go story, but I think target would be better, as it is a far better program.

No good for Target as there's no smelling of knickers involved..
