I am sure that is correct. They will use an assessor, or their accredited repairer to assess and quote. They possibly have an option for pre owned parts? (due to cost savings or non availability of older parts)

Definitely, although Insurance companies don't necessarily make this plain.  They will still want to assess themselves, if the repairer is not one of their "approved" repairers, and may dispute the quote.

Yes that is the decision we have to seriously make...

I think our excess is $300 so we would pay that but its still $300 we dont have...

So again with no legal obligation, I'm not going to give anyone money that I don't have if I dont legally have to...  will wait for the court summons then?

Current bank balance is $40 and this is a good week!
Savings? Yeah right!
Bank loan $28,000

So how I would even get the $300 I have no idea!!!
Scenario 1 - I lodge a claim, cant pay the excess so the insurance company refers to debt collectors who repossess the car ( worst case)

Scenario 2 - they can be bothered to take us to court and I negotiate to pay the courts at $10 per week...

I'm thinking scenario 2 will not even happen! but I'll opt for that it it does...

If I had $300 I could buy two new tyres that the car desperately needs!

There are some serious holes in the law and insurance system here!!!

I personally don't drive the car - I just have to work to pay for it all...

If you're not happy with their quote have you asked for another? If they were dealing with your insurance company then they'd ask for a couple anyway. Personally I'd just hand it off to my insurer and let them deal with it - you're fully insured so I really don't understand why you're messing these people around.

If someone reversed into me (which has happened), I sure as hell would be making them pay for it to be fixed, you might be happy with other drivers damaging your car but I'm not. As for "can't feed my kids because of this", if you can't afford to pay for your/your wife's mistakes when driving, take the bus.

I am pretty certain that the poor person your wife backed into will just end up contacting their insurance company who will take action.

AFAIK, 3rd party insurance will at least get their insurance company fighting for them. It won't get to court, you will have to pay the excess, and your No Claims Bonus will disappear. The Insurance companies will sort it out.

I can only imagine your wails of protest if someone did this to you...

Your financial problems have nothing to do with this.

jeez you had a crash and you have a moral obligation to sort it out.

The main thing is - requiring us to put in a claim?  there's no law regarding this is there???

No there is not, but the other party has a claim against you for damage, ( which you have admitted)

Now, you can either pay that out of your pocket ( which you appear not willing to do)
Or you can avail yourself of the liability insurance that your car insurance policy gives you, 

You have admitted that you/your wife is the at fault party, so either pay them, or get your insurance company to pay them ( covering the liability you have)

OK I contacted Fintel and they said if it were me that was backed into and I only had 3rd party insurance, they wouldnt do anything for me...  Which I agree is REALLY dumb but apparently thats how it is - so the lesson here is get full insurance on your car (AND your life!!!)

I'd really hope not. If it's an old crapper not a big deal. If it's a fairly nice car in good condition, I would want quality genuine parts used and a quality job of the repair in general from someone trusted, not joes back yard panel/paint/chop shop.
