About the only time a driver will get off after rear-ending someone is if they're in a truck and someone cuts in front (due to leaving a bigger following distance) while they're already braking. And that's after it gets investigated by the CVIU.

I didn't read all 8 pages so I apologize in advance if this has been mentioned.

If you have full\comprehensive insurance on your car you can lodge a protective\3rd party only claim with your insurer to get the other persons car repaired.  Usually this type of claim has no excess.

$800 is not that high. It the car is metallic or pearl paint then the entire bumper needs respraying to match the paint correct. And as mentioned a chipped or cracked headlight will fail a wof.

If it was my car your wife hit. It would be a resprayed bumper and a HID headlight that are over 1k 2nd hand

Oh, it's been mentioned. However OP is lucky in that the person his wife ran into only has 3rd party, so he thinks he can get away with not paying for their repairs.

I read through some of the pages afterwards and the gist I got from the OP was that he didn't want to be out of pocket for repairing the other persons car (via the excess on his policy) while sustaining no damage to his own car.

The person at fault is always liable for the repair of vehicles\objects damaged in the accident (regardless of who else has insurance or what type) and quite clearly the OP's wife is liable here.  My point is that the OP can file a 3rd party only claim with his insurer (which doesn't have an excess for him to pay) and his insurance company will repair the other persons car (which he is liable to do).

Also depending on the insurance companies there is the knock-for-knock agreement that someone else eluded to.
This is an agreement between some (not all) insurance companies where regardless of which party was at fault, both insurance companies just pay for the repairs of their own clients cars.  The costs of repair often are less than the admin required liaising, invoicing, recovering payments from other insurance companies.  This has no direct bearing on the OP himself, but simply means if both companies are in the knock-for-knock, his insurance company wont be out of pocket at all.

Didn't really want to open this up again, but hey its Friday...

I'll try to re-iterate my main point below:

Lets turn this around so I can be a bit clearer. If I have 3rd party insurance and someone hits my car, The other person has to voluntarily file a claim with their insurance company in order for my car to get repaired.

If they don't, MY insurance company wont help at all and my only option is to take it to court which seems like a bit of a hassle just to get my bumper painted.

Stupid - what do I pay my insurance company for exactly??? In this case it makes no difference if you have 3rd party or no insurance - you still rely on the person at fault to do something or the courts... This is the hole in the system...

I have had phone calls to the insurance company to confirm all of the above.


Back to the case as it is actually happening, My insurance company wont do anything until they talk to the driver at the time - my wife, and the other party as I understand has now gone overseas...

If I choose not to file a claim - because I don't LEGALLY have to, then sure the court case could be worse, but then again there is the chance it may not happen at all as well...

This isn't about the hole in the system... This is about you being honest and saying "Hey - I've damaged your car, let me take some steps to rectify this..."

Rather - Your approach seems to be "Hey, there might be a loophole here, so I've damaged your car - are you prepared to waste your time trying to get me to do the right thing..."

Honestly - I'd be embarrassed...

If the affected party does not want to chase you for it, and you can not reasonably get hold of them, then you have probably done all you can. Just keep a record of when and how you have tried to contact them in case they come at you later (not likely by the sounds of it).

You are right, it is a bit of a hole in the system, but if you only have 3rd party insurance, that does mean that your car itself is not insured, so you would have to chase through disputes etc (if the other party was being an a$$ about it) as if you were uninsured. The strange thing is that if you have 3rd party and an uninsured driver bangs into you (their fault), your insurance will cover you up to a pre-set amount (about $5k I think). Why don't the insurance companies help you out if an insured driver crashes into you??

How many court cases could be avoided EVERY year if there were a better way to do this? Like the insurance companies sorting it out between themselves???

Or am I the first person in the entire country EVER to consider not filing a claim ??? I think not...

Wouldnt a system that works 100% of the time be better than one that relys on a person to have morals???

Next you will be suggesting that murderers should march down to the police station and hand themselves in!

There is a better way to do this... You say "Yes, I have damaged your car" and then you notify your insurance company and fix it... Morals... Not an unreasonable expectation...

A bad one by the sounds of it...  I shall ring them again and enquire about this - however I still need details of the other party which I cant get at the moment as they are not in the country...

As already previously stated, I tried to ring them 3 times on the day as they requested me to and got no response at all, so I will await them to contact me cos I have no idea when they are returning.
