I just got one of those too, although it doesn't say what order it relates to. I think it must have affected more that just 'several' orders. 
 I didn't think it was an error as it was advertised as a sale, with 'INSANE SAVINGS STOREWIDE', and the pricing was for ex demo and old stock so the pricing seemed right, especially as it is a store brand that is closing down. I have been in stores that have big sales or are closing down before and got that sort of pricing discount. The word 'Insane' to me implies that the savings would be significant. So certainly didn't come across to me as an error, and I thought an error under the contractual mistakes act had to be an 'obvious' pricing error. eg advertising a $1500 camera for $10, when there wasn't a sale.The discounts in this case weren't that large, and it wouldn't be unexpected these days to get $50 off a $99 product when it is on sale in a store eg Briscoes regularly have 50% off sales on products. Total waste of my time. I am sure there are going to be a lot of annoyed customers.

There is probably not much you can really do, as there is law to protect retailers against pricing errors.  My orders though haven't been canceled according to their website, it still shows the order is  'in progress'. 
If I thought it was an error, I wouldn't have bothered, but it didn't come across that way to me, especially as noone else even suggested that it was an error in previous posts, and it all looked like genuine Insane sale.  What annoys me , is that in their email, it says  'we encourage you to take advantage of the amazing deals' again . Well I tried to take advantage of their 'amazing' deals last time, but they didn't honour them, so they must have been too 'amazing' to be true.

Personally I figured the $50 thing might have been related to the terms and applied to all orders as an incentive or something

I also noticed the $50 discount went away when you applied the 20% off code on orders over $251 when the total discount was over $50 which gave it even more merit. I've never seen a physical 'discount voucher'  for their online store so I have no clue what else it's referring to.

Anyone know a lawyer.. Need to find a way of forcing them to honour it, surely the law on pricing mistakes only covers the price of the item? They accepted a contract to supply items at price X (the correct price) and offered a discount of Y on that item. The items went into the shopping cart at full price, and a discount was applied to the order as a whole. IANAL but surely that stops them saying price X is a genuine mistake?

SCRATCH & DENT

REFURBISHED UNIT

Interesting... as I see it there was no mistake on they it simply appears that the "insane savings storewide" was a discount applied to the order. It was a promotional offer not an incorrectly priced product.

kiwijunglist: It was a pricing error in their cart when applying a 20% discount.


None of the products I ordered were over $50. They were all priced correctly on the website and when added to the cart. When I ordered multiple items a $50 discount was applied to the total order. This is a promotional discount, the individual items are all priced correctly in the cart.

The term they are trying to use I believe is this one - "ordered product is not available or if there is an error in the price or product description presented on the website"

However the ordered product is available and there was no error in the price or product description presented on the website. They are really trying to backtrack on a promotion applying to carts with multiple items. I think their T&C could be clearer and should be updated to cover this situation.

something like ...if there is an error in the price or product description or discount applied to one or more products individually or collectively...

The products were incorrectly priced if the total came to $50, when you applied the discount code.

For example

3x $15 earphones
1x $5 case

Total $50 + $6 shipping = $56

Then I entered the 20% discount code

Total $50 - $50 discount + $6 shipping = $6

Clearly an unintentional pricing error, The error was at the checkout, so it can not be argued that they lowered pricing intentionalally to get more visitors to their website, as the error only happens when you placed your order. From memory their are provisions in the fair trading act for unintentional errors, so I think contacting a lawyer would be a unethical and a waste of time, but let us know how you get on.

IANAL but I'd be very surprised if they can tell some customers its an error, and honour it for other customers (who may have ordered more expensive items where they won't loose as much money on the deal) and get away with it.. That would surely be shaky legal ground.

I've replied to the denial email telling them it's not acceptable, and that they can't get out if it as a pricing error because the items were billed at full price.

Problem is they probably have liquidators that ok'd the nano because it was still within their acceptable price for it unlike other products (knife set for $6 shipped).
