Hi,

I purchased some car bits off someone who is based in Christchurch. Basically interior seats for front and back. Turned out postage would be too much. So decided to not continue and he would refund me. Since then its been a month. Only got half of what i am owed back. I have all chat logs from facebook (Parts advertised on a BMW page)
I have asked multiple times for him to refund the remaining but had no luck.

What to do? Call police and log a report for it and get them to serve him?

After doing all the obvious (trying to resolve it directly, warning of dispute etc), your next option is: http://www.justice.govt.nz/tribunals/disputes-tribunal/how-to-apply

(Police won't be interested as it's a "civil matter" - as far as they're concerned anyway).

EDIT: Just some advise in relation to step one (trying to resolve it directly) from experience of dealing with a number of these issues for myself and on behalf of others; be specific and objective.

i.e.

 

     

  1. On this date I paid you $$$ for XYZ.
  2. On this date I requested refund which you agreed to via attached correspondence.
  3. To date I have received only $$$.
  4. I request you pay the remaining $$$ in account **** by [reasonable but defined date] or provide the reason you are withholding payment in order to have this issues resolved by disputes tribunal.

Disputes Tribunal will give you every support... short of actually making the guy pay. It was a complete waste of time when I went through that process.

You could try an collections agency like bay collection

All depends on the amount, which you haven't said.  But how do you know they won't finish off paying you in full. If they have paid some, that is a good sign. I always use safetrader myself when dealing with larger amounts for personal trades, saves so much hassle

How did you pay? Is the bank not able to reverse the charge (depends how long ago you done this too)?

It was $200 including postage. Peanuts to be fighting over.

You should give them a quick ring and discuss with them just on the off chance they can do something? Worth a shot and you'd be no worse off if they say no.

Hmm, I dont think his intent was to scam really. Just ended up that way for him. Seems to be VERY lazy at communication and was apparently busy with his new job. Thanks to facebook i know where he works and who the boss is so i could be nice and cost him a bit more than $200.
