what if they got sick and is in hospital fighting for their life? i suppose they'd still get stung, such is life

These threads always makes me laugh. Of course Trade Me aren't going to give you legal advise, and there are a handful of obvious reasons why this is so (and so it should be).

As just one example, it would cost them a fortune just to get up to speed on the situation, let alone engage a lawyer and bring them up to speed on the nuances of every dispute before providing advise.

You might think Trade Me charges a lot (and sure, they do), but if they had to provide legal advise every time some trader had an 'issue', they'd go broke pretty fast.

If you’re a private seller and sell items through an online website/auction website, the Fair Trading Act and the Consumer Guarantees Act don’t apply.

 

The Contractual Remedies Act may give a buyer some protection when they buy from you in this situation, but to seek a remedy under this Act they must show:

 

  • they were persuaded to buy the item by what you said about it
  • what you said was untrue
  • your untruths caused them to lose money (eg they had to pay for repairs when you told them the item was in excellent condition).

Record it, there are phone apps that will do this.  If not over the microphone, by placing in speaker mode do this without issue.

Send a letter by registered post to him.

"This letter is to give you notice that I will hold your item for 28 days from the date of this letter. If not collected by the end of that time I reserve the right to re-advertise the item for sale and no refund will be given to you."

That will either motivate him to get on with it or give you a reasonable backstop if he springs out of the woodwork at some future date.

What he said. It amounts to the same thing - just go into the PO and tell them you want it tracked and signed for. No claiming it never arrived etc then.

Your emails maybe going into their spam folder. But if you send the message via the feedback dfunction, they will at least be able to see it, and trademe also emails them the feedback.

Ring him to see what the issue is. It will take you two minutes to get to the heart of the matter. Much better than wasting time electronically and then move to registered mail if you think it is going to be a problem.

Why do people insist on doing it the hard way?
