Hi all,

 

I just purchased a Jurassic Park collection from NZGameshop.com

I purchased this mainly for the UV digital version. Microsoft was selling the digital version for around the same price.

 

When the product arrived, the digital version did not work. I got an error saying it can only be redeemed in the UK.

 

The listing itself clearly shows in the image that the product comes with Bluray 3d + Bluray + Digital HD UltraViolot"

 

The title of the product says "Jurassic Park Premium Collection Blu-ray UV"

 

 

 

The rep i spoke with initially said "UV is the type of disc". This isn't correct, UV is the digital locker. The type of disc is Bluray.

 

They then said "the digital version was a free bonus". That also isn't correct - it was part of the package.

 

They then said "The disc is region 2/B so won't work in NZ". Now i became frustrating as this wasn't about the disc, but the digital version. In addition, this was nothing to do with the disc and region B is NZ's region.

 

 

 

They then acknowledged the digital version would not work in NZ and they would have the listing updated, but again advised they would not do anything for the error.

 

 

 

I was not after a full refund, i was just after perhaps a credit of half the value or similar, so i can purchase the digital version elsewhere.

 

 

 

My question is, am i in the right? Someone please slap some sense into me.... i'm more frustrated with their response.

Welcome to DRM. Lesson 2 will be when UV out of the blue decide it's not worth it anymore and turn off their authentication servers leaving all "your" UV movies to go up in digital smoke. If you need a file-based copy of the BluRay that you legitimately paid for, there are several ways to do it.

You'd be in the right if they were an NZ company, but it's a British company you purchased from so you're probably out of luck.





Information wants to be free. The Net interprets censorship as damage and routes around it.

It's a pity the copyright rules around format shifting do not extend to audio+visual works (just audio), if they did you would be able to use MakeMKV to rip the Bluray to your computer and Handbrake to convert it into a digital format of your choice (probably at a better quality that came on the disk).

I agree, you are in the right in that they were selling it into NZ and should have been clear that the Disc would work, but not the UV version.

 

Good customer service would mean they you give you at least a partial store credit.

 

However legally you are out of luck as they are a UK company an you have no rights.

 

Personally I'd cut my losses try and sell the disks if you only want the UV copy.

Lesson learned.  Lucky it was only $25 i suppose.

I would argue that nzgameshop owes you something. In fact, you could pressure them for a refund based on this, from Consumer Magazine, in regard to another retailer.

 

In particular:

 

“Consumer law applies to all traders who advertise directly to Kiwi consumers, even if the trader is based off-shore,” she says.

 

“BecexTech, like any trader operating in New Zealand, has to comply with the CGA. It must guarantee its products are of acceptable quality and provide a remedy when they’re not. If it misleads consumers about their rights, it also risks breaching the Fair Trading Act.”

My wife took it upon herself to keep complaining and they have now offered to refund 30% of the price, which I consider to be fair and reasonable and have accepted.

They will also be updating their ads to make it clear the digital versions won't work in NZ.

It's good that they've come to the party - and good on your wife.

 

It's also worth noting that under NZ law, if a supplier gives you a free gift then that is also covered by the CGA and FTA. So whether it's a 'free bonus' or part of the package, if it doesn't work then there is a comeback for the consumer.
