Hi folks,

I live in a complex where there is a shared driveway of around 7m wide to 10 units.

Over the past few months the first unit started to park on the side of the shared driveway.  They are a bunch of flatmates each with at least one car.  If they wanted to, they could park efficiently on their on property - it's like tetris but hey, it's all about being considerate.

It is prohibted to park on the shared driveway.  I have contactedd the body corp and all they can do is talk to the first unit.  What if one day a firetruck has to get through?  It wouldn't be able to.

Anyone with the same experience with any possible solutions?  Many of the residents of the complex have spoken to the body corp and to the first unit but well, they are too inconsiderate to even care.

Help!

Are they renting? If so, try to contact the property owner.

Oh, a fire truck would get through.  Those bumpers aren't just bling.  Tongue out

Have you spoken to the actual owner of the unit?

According to my other half, blocking a shared driveway is illegal and you are well within your rights to get them towed.
If they are tennants (as opposed to owning the place) then chances are they will be in breach of their tennancy agreement as well.

Yes, they are renting.  I have no idea who owns the property though.  Is there a way to find out?

Actually, a firetuck wouldn't be able to get through if a car is parked on the driveway.  It's not all that wideXD

Nope, I have no idea who owns the property.  Is there a way to find out?

Does this mean I can ask a towing company to tow the cars away?  How would the towing truck company know whose is the right and wrong?

If you're in Wellington the body corp could do a deal with the devil AKA Harbour City Tow and Salvage to tow any improperly parked vehicles if they don't have the backbone to sort it themselves. The Fire Brigade wouldn't be slowed down much by just a few cars.

The Body Corp would know who the owner was as they'd be a part of it.
Not sure if the Body Corp would actually be able to do any more than ask the owner of that unit to fix the issue.

I would suggest that you go back to the body corporate.  Two observations about body corporates.

1) They are just doing a job, it's just a 9-5 thing for whoever you are dealing with.
2) As such, they need a little bit of prodding if the problem is not causing them a headache... basically you need to make this problem their headache (by hassling them).

When you talk to them, ask for the following.

1) Ask them to talk to the owner of the property, that is who they deal with, about the problem.
2) More importantly, ask them to errect towing zone signs, they may need to raise it at the next body corporate meeting, but it's worth pursuing.  This will serve two purposes.  It will allow them to easily two cars parked in shared areas, and will probably have the affect of stopping the problem before it comes to towing.

My suggestion is to contact the body corporate every few days about the problem until they agree to do something, and then keep at them until they complete what is agreed.

Cool site but for some odd reason some houses are not identified when I choose to view "Identify owner" option.  Darn it, would've been a good way to find out the owner of the house.

And I was thinking they were project managers or something of the same ilk.

Good idea.  The problem is we only have one meeting per year and it happens in November.  I like your towing zone signs solution:) 

You know, it took the body corp 3 months just to get our complex signage back to normal after the letters were damaged!  3 whole months when it should've only taken days!



My suggestion is to contact the body corporate every few days about the problem until they agree to do something, and then keep at them until they complete what is agreed.

Who do you pay, do you have a property management company doing the day to day stuff? If you want changes to the rules etc do your lobbying before the meeting.

The map naming of property owners probably depends on whether the owners have allowed their names to be public on the local rates roll.

Yes, we all pay fees to a body corp company looking after the entire complex.  They even look after house insurance matters.

Maybe a good looking fake tow away warning notice put under the windscreen wiper of said car may give them a hint
