DonGould: and it's just occurred to me, how can I be sure that this is the same as the original?  I don't have rights to view the original... I'm so confused - beer.

It might not be infringement at all! For all you know, since you haven't seen the original, this could be a completely new work with a similar name.

So you're saying that all I need to do to my 4,000TB of p2p file shared movies is give them different titles and then all of your downloading my copy of t2 just to understand if it is the original or not, are in the clear?

...what's the url of that stike web site again?  I'm hell confused now.

I am safe as I used my VPN and Netflix account to view it.

Breaking the Terms of Service isn't the same as breaking the law.

And anyway, it's in another jurisdiction.

Also you get paid this way so you can't complain.

Didn't anybody tell you I was a hacker?

Craig, given your price and the clear demand for this file, I'm keen to talk to you about a licensing agreement for this work. I can see a business opportunity to provide a legitimate copy of this work up for sale. Could you please advice a price for distribution rights in New Zealand for the next 5 days?

richms: It was a vauge and stupid wording of it, but it had something about connecting to multiple users in it and the general view is that its not supposed to cover hosting based downloads. You cant prove that anyone made a copy of things just by the fact that there is a http request either.

a) material is uploaded via, or downloaded from, the Internet using an application or network that enables the simultaneous sharing of material between multiple users; and(b) uploading and downloading may, but need not, occur at the same time

A web browser is not an application that enables simultaneous sharing of materials between multiple users.

The server the file is hosted on might count, but it would be brave to assume that a browser met that requirement.

DylanReeve: Guys, I have created a copy of the file which you can download at http://dylanreeve.com/lennon-copyright.txt - I promise I won't turn over your IP details!!!

Disclaimer: This file is provided for those who have misplaced their legitimate and legal backup copy of their appropriately licensed "copyright.txt" - I do not condone piracy in any way.

You altered the original works.  Is that legal?

Seems to me that you've republished someone elses works, given it a new title and are now hosting it on your own web site.

...or am I just reading it wrong?

Edit:  and it's just occurred to me, how can I be sure that this is the same as the original?  I don't have rights to view the original... I'm so confused - beer.

Grrrr.. I think that may deserve a DMCA notice to the hosting provider. (as the illegally copyrighted file is hosted in the USA).

Thanks :-)

At the other end of the absurdity scale, is that it uses "the internet" which last I checked had multiple users. Piece of **** legislation thats as clear as mud which will need someone to go to court to sort it out.

You're welcome.

But are you able to put some resources in to addressing my other question regarding distribution.  I suspect the commerical window for me to make some profit for us both may be closing.
