So I am in the process of trying to get fibre connected down a ROW, I have the all good from my landlord but trying to get consent from the other two property owners looks like it will be difficult as with UFF I am expected to do it myself. I dont know how Enable and Northpower go about it but I know Chorus does all the consent work when they do it and I'm pretty sure the reason for the disparity comes down to the contract negotiations that happened for the roll out. But honestly I wish all the LFC's did it that way sure i might have to wait I am anyway and I expected that.

I know one of them is a renter and the other i don't know (shows how much we know our neighbors these days) I have tried to leave the consent form with a letter for them but that hasn't got me very far. So now I am left to try track down the owners other than door knocking which still could leave me in the same position if the renters are going via and agency (doubt the agency will give me the owners info) I have no idea how to proceed if that is the case. Has anyone else been through this or have any ideas that may help?

if you are trying to get owner details for a rented property, go see your local council, they have property records on file and are required to provide the information on request under the local authority laws, you may have to pay a small fee as they are entitled to recover the costs to provide this information.

Most likely the property will be registered to a company, you can easily look up the shareholder details on-line at companies.govt.nz, this will give you a name and address to contact.

the council web site will most likely only display rating information, address, valuation number and the ratable value, it usually will not contain actual owner details

Yeah that's all it has from the looks of it. Looks like I will need to find time for a trip to the council.

Maybe check with UFF and see if they will accept the property managers signature for the property?

Might make it easier to get a hold of/obtain a signature.

If someone wants UFF connected, then , there should be a clearer guaranteed process to gain consent.   

 Councils won't release the info if you request, due to privacy laws so the status quo is largely unworkable. 

And, if a neighbour says no, it is completely ridiculous that you can never connect broadband.  Imagine if the same applied to water/electricity / sewage -- a neighbour could block connection of these vital services to a new house build.

Hmm, really? I tried to get some information from my council as i needed some consent, and the council refused. The owner had requested privacy. 

So, i asked the council to pass on a message on my behalf. 

It was a royal pain in the bum.

28AInspection of complete rating information database

 

 

(1) In this section, and sections 28B to 28D, database means the database—

 

     

  •  

    (a) that the local authority must make available under subsection (2); and

     

     

  •  

    (b) that contains the information required under subsection (3).

     

 

 

(2) For the purpose of inspecting any information in relation to a particular rating unit, a copy of the local authority’s complete rating information database must be—

 

     

  •  

    (a) available to any person—

     

       

    •  

      (i) at the principal public office of the local authority; and

       

       

    •  

      (ii) during office hours; and

       

     

  •  

    (b) accessible to the person by the person—

     

       

    •  

      (i) accessing the database by himself or herself; or

       

       

    •  

      (ii) requesting an officer of the local authority to provide the information.

       

 

 

(3) The rating information database made available under subsection (2) must include, for each rating unit in the district, all the information that the local authority holds in its rating information database in relation to that rating unit, including—

 

     

  •  

    (a) the name of the owner of the rating unit; and

     

     

  •  

    (b) the postal address of the owner of the rating unit.

     

 

 

(4) The local authority may make the database or any part of it available at any other office of the local authority, but only in the same manner as it is accessible by people at the principal public office.

 

 

 

(5) No fee is payable for inspecting any database made available under this section, but a person may be charged a reasonable fee for being supplied with a copy of the particulars.

 

 

 

(6) For the avoidance of doubt, a person may make, at the same inspection of the database, a series of requests about particular rating units, as long as the requests are—

 

     

  •  

    (a) related; and

     

     

  •  

    (b) for purposes other than for the bulk collection of the names or postal addresses (or both) of people included in the database.

     

 

 

(7) This section—

 




Print that out and take to your council, it's quite clear "Avaliable to any person"

how does it work though, if the address on their records is old? Potentially, you'll never get hold of them.

I would think it is current and accurate as that is where the rates bill goes and its a good assumption that the rates get paid

I would think it is current and accurate as that is where the rates bill goes and its a good assumption that the rates get paid


well, i thought of that, but, maybe some people just go into the council office and pay without receiving the notice.

Water, electricity and sewage are considered differently under the Resource Management Act, which means that you do not need to go through the consents administrative red tape to install through a shared property. Sadly, Telecommunications is not considered as critical infrastructure so it is not covered under the RMA.
