Not sure this belongs here, but I couldn't decide which forum was more appropriate than this.

A domain that I am keen to acquire is listed as Pending Release.  Am I allowed to contact the domain registrant using the WHOIS query results?  I want to check whether they are actually letting it go and might let me take it now, or if they've just forgotten to reregister.

I note at the end of the query it states:

"Users are advised that the following activities are strictly forbidden.

Using multiple WHOIS queries, or using the output of multiple WHOIS
queries in conjunction with any other facility or service, to enable
or effect a download of part or all of the .nz Register.

Using any information contained in the WHOIS query output to attempt a
targeted contact campaign with any person, or any organisation, using any
 medium.

A breach of these conditions will be treated as a breach of the .nz Policies
and Procedures.  Sanctions in line with those specified in the policies and
procedures at www.dnc.org.nz may result from any breach."

Is this a targeted contact campaign?  Or is a simple one off email asking if I can have their unwanted domain OK?

Yes, that is absolutely fine. That statement is just there so people can't go spamming people (by email, snail mail, or other) saying stuff like "host your domain with us instead, we're $5 cheaper than XYZ provider!". Not that it stops most of them anyway, but meh.

Simple one off, not-automated stuff is fine. I often have this sort of contact both ways regarding domains I own, or want.

Thanks.  The registrant's email is @dia.govt.nz (Department of Internal Affairs) so I wanted to make sure I didn't get on their wrong side!

If you weren't going to reregister anyway, would you try and get money out of me for it?  I hope not.  I guess I wouldn't pay for the domain, I don't want it that badly...

Yea normally it's in that state for 90 days, so they could still make it theirs until that time is up.

I know that, but I'd rather take it now then wait 3 months and find they actually had just forgotten to reregister it and not get it then either.  Doesn't hurt to ask, but the email bounced so I'm left with trying by phone which seems a bit too personal...  oh well.
