How are they going to be policing this?  Couldn't you tweak your software to get around this? ie change your ports/enable encryption/disable connections from certian seeds?

Sure, just means that everything which looks like an encrypted data stream potentially get handeled at a lower priority until they figure out ways to identify traffic again.

Rather like the battle against spam etc.

Depends how they implement it. That's why I asked how they're going to be policing it? ie, are they going to be utilising the full feature set or will they be using a subset or smaller filtering techniques.  Either way I don't care as i'm not now, nor ever will be, on Slingshot.  My point is that there are ways around this kind of things at every level - unless they're using full on anal probe filtering.
