Note to all: You would struggle to convince many people that you "own" a number obtained through the 2D website, on a SIM, and/or via Trade Me.

Also, having title (which I doubt you do, with a phone number) to something in New Zealand does *not* necessarily entitle you to do whatever you want with it.

Wade: There is a glaring issue that people are missing here, this message pops up when you pop onto My 2Degrees.... What happens to the poor guy who forks out for a SIM on TM, then the seller doesn't donate proceeds and SIM gets deactivated? Seller doesn't care, it potentially becomes a hideous marketing exercise for 2D....

Seller does indeed care, since if you sell something you do not own and have no right to sell (e.g. a 2degrees phone number) it is called Fraud, and is a criminal offense. I imagine the police knocking on their door will get them to stop fairly quickly

Oh Yes, I can really see the police knocking on your door in the middle of the night for that most heinous of crimes: trading a SIM card. It's so much more importatnt than all the other things they don't bother knocking on your door for like burglary etc.

I tremble in my shoes at the very thought of it!

The police dont turn up to the people doing actual fraud on trademe, or to someone who has seen someone break into a house, What are the chances of them turning up for this??? None I would say...

1 Could you please explain why it's ok for 2D to put a raft of desirable numbers on the (TradeMe) market but prevent everyone else from doing so? Whether or not the proceeeds go to charity is neither here nore there; the fact is that you trade numbers on TradeMe but now want to prevent others from doing so.

2degrees chose to give away a selection of our 'golden numbers' as a donation to charity to mark our launch and to generate awareness of our brand. The vast majority of New Zealanders saw it as a very positive and generous gesture. As we've made clear in our terms and conditions, we are more than happy for others to do exactly the same.

2 Where in your terms and conditions does it specifically exclude SIMs and Numbers from being traded other than on the page where you have the option of changing your number? I expect that many people who already have a number that may have some market value attached to it will not have even have had the need to go on to the 'change your number' page.

The full set of Terms and Conditions available on the web site were updated on the same day (25 August) that we added the line of text to the website to give us the right to terminate accounts for numbers that we find for sale (clause 18(f)). By using our services, customers agree to our Terms and Conditions, including as amended from time.

3 Do you intend to cancel the SIMs of those numbers already traded (other than your own of course, if you apply your double standard)?

Absolutely not. Numbers on SIMs activated BEFORE the change in our terms and conditions can still be traded (because that's only fair as people weren't aware of the change). But numbers activated AFTER we changed the Terms and Conditions can be terminated if they are found for sale.

What is their interest interest in what people choose to do with their number?

We think that giving our customers the right to pick a number that they really like is a privilege (let's face it, no one else offers it). We don't charge for the first number chosen since we want all customers to get a fair go to choose a number they like. It does not benefit us or our customers if a small group of people hoard all the good numbers then try to sell them at a premium simply for their own personal gain.
