Yep. I think I am going to exert my right as a consumer. Don't think it is acceptable that last week Wednesday, they told me the manufacturer had just received the phone and are looking at it, and that I should have an answer by early this week. Now they tell me they are still assessing it, and could be next week when they may have an answer. Don't think this is on. Their responsibility is to me, the consumer. I believe that this is a serious fault, considering it was out of the box and quite an expensive item and I have the right to a refund or exchange ASAP, regardless of what the manufacturer says.

Most products will have a 1 to 1 exchange period...most phones have 14 days but this may vary. It is not in WHS' interest to provide you with a 1 to 1 exchange since the product is popular with substantial GP, secondly they may not have stock to provide you with the exchange. As a result, they decided to send the unit back to Samsung Service Centre (SSC) at the disadvantage to you not having the product, while it is at their advantage that you have already paid for the product.

If SSC decide to repair your unit, it will still take some time for parts to arrive as they are usually sent from overseas, furthermore with the high demand for the phone, there will be very little allocation for spare parts. If SSC decide to replace your unit, your replacement unit will be prioritised very low due to the high retail demand which will still result in a long wait for you. Both of these potential outcomes are at the discretion of SSC. 

I believe what WHS should have done is to provide a 1 to 1 exchange as soon as more stock came through, but instead, they threw the responsibility at SSC. 

In your particular case, the unit faulted prematurely within a unrealistic timeframe. You should demand for a full refund, scrap a few bucks more and purchase it else where, stock levels have stablised, so it wont be difficult to find one for sale...If you still cannot get any valid outcome, request for contact with head office this will "scare" and provide you with a more "directive" service to you...

would some one know, if we can get the S3 from Harvey Norman under the 36 month interest free option. I am interested to know what would be the approx monthly payment. and if any other fees (like establishment etc)

I dont work for Harvey Norman but you will be looking at approximately over $30 per month over 36 months (based on $50 establishment fee, although I am not sure if that is GE's charge but most finance companies are) with an additional monthly fee of about $3-$6 per month...depending on your credit/job history, GE may require you to take the "protection plan" which increase your monthly repayment by $2-$7 per month, it is GE's insurance in case if you lose the ability to repay the remaining payments, have a look at the fine prints but some of these protection plan may also protect you if the item is stolen or damaged...Have a look if  there are any months deferred...also, the more initial deposit you place down, will increase your likelihood of being accepted without additional conditions or not accepted...Good luck.

GE has $45 account fee payable every year. Read the small print on the AD for more info.

am just thinking of taking a trip to a couple of places who can offer the phone on monthly payment.

Are you currently on a plan? How much per month do you spend?

Phone is free at JB on a $90/month plan (plus I think you get a $100 JB gift card)
Free from Vodafone on same plan (no gift card)
Free from Telecom on $100 plan
Free from 2Degrees on $89 plan

Damn sorry to hear that. I think try push it with the WHS because you're covered by the consumer protection.
Within the 14days you can get a replacement. Very unfortunate for you bud. May be due to the low supply of S3 right now is the cause of the limbo.

Which part of the?Consumer Guarantees Act says you're entitled to a replacement within 14 days of purchase?

I've always been able to get a replacement and money back within that period. But I think I'm being misleading here. My apology. May be that is stated by the trader guarantee.
But he can still ask the trader for a replacement if the repair is taking too long.

He should not have to dealt with the manufacturer for his repair either. He has the power to either ask for refund or replacement within a suitable time frame. If warehouse stationary has a product to replace in stock then he can ask for it and let WHS sort things out with manufacturer. That is what I understand.


Yes, some traders promise to replace faulty goods if returned within a certain time frame, but it's not actually part of the CGA.

You are perfectly correct in stating that any repair work should be done quickly.  And he shouldn't have to deal with the manufacturer if he doesn't want to, he can let the retailer do all of that.

I rang WHS Albany yesterday afternoon and enquired about my S3 pre-order. The lady I spoke to said they had had a huge demand (no surprise there) and were shipping up units from the South Island to meet North Island demand (no one wants them in the South Island?) ETA was next week some time.

I think we've more people in the North Island than the South. The ratio might be somewhere between 2/3 North and 1/3 South. Probably this is why they don't have much demands down south or many most South Islander cannot afford an upgrade after bought their iPhones lol.

Anyway back on topic.

UK Pre-orderers of the 32GB Galaxy S3 are also screaming and demanding their phone to be shipped to them. Some of them even made their pre-ordered since May 14th and yet to get their phone. Vodafone UK did not know when they will be shipping or having the phone either. Yet their website saying that they have those phones in stock. This is very fishy some how.

This really got me questioning how on earth did Expansys.co.nz has them in stock (total of 84 last few days now down to 40).  Have any one ordered the 32GB from Expansys at all? I want to see that the phone exists, not just some annoucement by Samsung but then never got around to manufactured the model like they did with the Galaxy S2 32GB with some lame excuse of the production cost is too high and will not be worth it blah blah blah..

We're the consumers, we have the money to buy if the company provides us the goods. There are always someone to buy the 32GB and 64GB regardless the cost. Take a look at Apple Iphone4S 64GB, there are not many of them made but yet you can still get them and it is costly.

NL Moorhouse Ave in Christchurch are just unpacking their delivery of Blue VF 16GB. 4 are for pre-orders (including mine hopefully) so they said on the phone, and they may have a couple more for sale off the floor. Lucky they're only one block away :)

Got it. Now to try out the purchases with it. And see if I can get Sygic working with maps on the External SD card.
