If the landlord is clearly stating that the place is not ready, yet expecting you to pay - keep that documented, as you can probably get the payments that you have made in advance of a non-ready property taken into account at the end of your tenancy. If the landlord wont play ball, I'm sure the tenancy tribunal would :-)

Also make sure you take a water and power reading the moment you step in the door. Photograph if possible.

the start date is the date you sign on the form

you can argue it wasn't habitable, but other than being inhabitable you have to pay .... so is it inhabitable?

IANAL but if you are unable to fully benefit from the property being leased (i.e. due to occupation of the premises by the landlords property if otherwise silent on this in the tenancy agreement) then I am guessing there would be an argument for recompense. I suggest reading the appropriate legislation.

Right so all is well :-)

The landlord is moving his bits out during the weekend, only has some rubbish left that will be collected Monday.
It's been cleaned and the carpets have been steam cleaned as well.
They were flexible enough to allow me to set the start date on Monday which works for us.

1) Should be getting the keys tomorrow
2) UFB application submitted with BigPipe
3) Shipping company supplied with address

Everybody's happy. I hope :D

I remember after the christchurch earthquake you had to pay rent even if the house was damaged. Unless it was "inhabitable".

I'd disagree with that, I love Auckland. It's a small city compared to London and has got a lot to offer. As much as I love the natural beauty of rural NZ I would likely miss a whole bunch of things.
My work is in the CBD and its unlikely that will change unless I shift directions in my career which wouldn't be a wise financial decision

Yea everybody complains about the traffic in AKL but it's laughable if you're used to London. A commute to work by car would take me 3 hours, by train 90 minutes. Here it's a 20 minute drive in slow-ish but moving traffic :D

when i was in melbourne, travel to anywhere involves 60 mins off peak, 90-120mins peak, and stopping at no less than 50 traffic lights in the process, with traffic at a standstill if someone wanted to turn right from the right lane! so you need to anticipate and squeeze left otherwise you will not get anywhere

. in the CBD you move 1.5km over 1 hr. it's "normal". it's not normal when you do it over 1.5 hrs. thankfully i lived 1700m from work ;p

and that's been voted the best (most livable) city 2 years in a row now by some american organization ... ! maybe their entertainment is tops! [if you get there on time ...]

oh oh ... and restaurant bookings? no such thing .. the most popular/best ones have a queue 200 yards long outside the door to wait for your turn to eat. first in first served. and people queue!

Couldn't live in Melbourne. Found the city to have "no soul", lots of grumpy folks and miserable weather during most of the year

As someone who moved from Auckland to Melbourne I'd have to disagree. Every time we are back in Auckland (usually a few times a year), we find it completely lacks any soul compared to Melbourne.

As someone who moved from Auckland to Melbourne I'd have to disagree. Every time we are back in Auckland (usually a few times a year), we find it completely lacks any soul compared to Melbourne.

Everybody interprets different places in a different manner compared to their personal views and experiences, that's why it's good we have the liberty to live where we want (providing you meet legal requirements) :)

I quite enjoy the cafe culture in AKL, the waterfront/viaduct, the many fine eateries and cafes around the beaches such as Takapuna and Mission Bay and the water that is everywhere around you. There's definitely room for improvement around Queen St and other areas of the CBD (more trains and apartment buildings would help to increase the "density")
