You've posted in a public forum and asked for advice, just because you don't like the advice, doesn't mean it's wrong. 

 

The litmus test here should be, what would a reasonable person do, and I think you'd find the majority of people wouldn't make a big deal about this, so perhaps you should, for your own sake, just let it go.

 

If you upset them by making a big deal about this, expect escalation, and one day you might need them to agree to something they could be difficult on (like shared driveway access for UFB or similar).

 

Your call of course.

@heavenlywild To me it sounds like a one off that your neighbour has hung a rug over the fence and you are asking about the law on this!

 

Unless you give us more detail like how often it's happening then of course you sound like a sad neighbour!

 

If they are hanging the washing up often on the fence then I could understand you not being happy about this as I would not be happy either

On one hand - fair enough, I maybe should have stuck to the exact question rather than being glib.

 

 

 

On the other hand, you got feedback - it just perhaps wasn't the feedback you wanted to hear!

 

 

 

Maybe if there was more context? Perhaps this neighbour really has been a total jerk to you for years now and this is just another example of a long litany of passive/aggressive behaviour from them, perfectly calculated to frustrate and annoy...

 

Without that context however, we can only go on what you have given us.

 

Yes - I am sure if you really wanted to, you could use property law to prevent your neighbour from hanging their rug over the dividing line fence once in a blue moon.

 

If the above line doesn't sound as ludicrous to you as it does to me though, we are clearly living in completely different worlds!

My personal opinion, if it is a one off then it should be fine. But they should ask if it becomes frequent. It is just a matter of courtesy. 

 

But, it also depends on the neighbour , whether they are friendlly or obnoxious, etc.  

 

One of my neighbours are poor excuses for people, disrespectful, noone likes them and they are a nuisance. Prefer to burn household rubbish than use council facilities. Who does that in the city?

I think you should call the Police, but not 111, use the new number (105) as while this is a serious incident, its not an emergency. Then you should call your lawyer. Alternatively, you could hang YOUR rug on the fence and have a rug-airing party and get to know the neighbors.

That said, it wasn't a question of etiquette that was asked (which I am sure would have been answered with more grace and consideration and less of a pile-on!) but one of law - hence the perhaps the more robust and teasing responses...

I'm assuming that law would be similar to overhanging trees? In that any branches that overhang into your property, you are allowed to cut down but the actual branches (or fruit, if it was a fruit tree) still belongs to your neighbour so you are obligated to return them to the neighbour.

 

 

 

To clarify I am in no way suggesting to the OP that they cut the rug overhanging on their side of the fence.





If you can't laugh at yourself then you probably shouldn't laugh at others.
