Yes. Are the palings rotten? Are the posts rotten? Say the posts are not rotten, might look ild but if they are not rotten just fugly, then maybe just palings is enough to make it adequate, that type of thing. No doubt 16 wants a cool new fence but the requirement is an adequate fence
I agree with everyone who says they are being a bit cheeky by asking for a 1/3. 14A and 14B are a single lot, so it should be a 50/50 cost split between 14 (collectively) and 16.
And as many have already said as well, it also depends on the condition of the fence. Do you genuinely believe it's not in need of replacing?
Have they presented you with a quote? We had our approx 30m boundary fence replaced with a new basic timber paling fence a year or so ago and builder charged about $2000 (that was entire replacement, posts and all - along with removing old fence first).
Depending on where you are located, round $75-$100 per lineal metre for post / rail / pailing fence shouldn't be beyond the realms of a normal quote.
How much are you actually talking about here?
You have said you'll go consult a lawyer which may be the smart thing to do if they are trying to claim a fortune, but, if its not a big bill, is it really worth incurring legal expenses for? A quick 3 way chat / email about possibly 14a/b accepting 50% of the costs may be enough to at least start a conversation without the need to get lawyers involved.
And if you're in Christchurch I can put you onto a builder who does a great job and will very likely be cheaper than whoever your neighbour has a quote from. I'm pretty sure is was $60/m plus GST when we did our last one.
