It's virtually impossible to buy a new section without covenants these days. Just because someone wants to build a small footprint house, or put a relocated house, tiny house, or something like that on a section doesn't mean they will be bad neighbours or ruin your peace and quiet.

If you buy a section that someone has subdivided off their back garden, those can sometimes lack covenants. Although sometimes those can also have the worst covenants. Supposedly they are to 'protect your investment', which is often the wording used by real estate agents when they are selling land with covenants on them.

If you can get enough enough affected owners there is a process you can apply to get covenets overturned,

I'd imagine it's difficult if not impossible to transport a house onto a rear subdivided section, but yes building a tiny house etc potentially would work.

Some updates:

- On 01/05/2019, we called the 0800 number of PROPERTY TRADE FINANCE again, no one answer the phone.

- Same day, my wife called "Trent's" mobile. He hung up the phone once he identified we are the owner of the section.

- Called "Trent" again, and request "Trent" to answer our questions. "Trent" refused to answer, or simply said "no comment". We asked him if they refuse to review/sign-off our plan, does it mean we could build whatever we want without their consent. He refused to answer again, and ask us to talk to our solicitor. And then he hung up again.

- We are contacting our solicitor to see what we can do in this case.

- We are trying to contact other section owners who having the same difficulty. But could not get hold to anyone yet.

Hi every one, if you know of anyone at the same subdivision having the same problem. Could you please let them to contact/PM me? We may able to jointly sue this "Trent" person, or the land developer, aka Parklane Infrastruc Limited.

Yeah, I'd be getting my solicitor to contact the director if it were me. He might be completely unaware, and you would think he wouldn't want has staff's actions giving his company and new subdivision a bad name.

I don't think this "Trent" guy dare to do this without his boss's permission.

I had sent the company multiple email and asked them to repeat what "Trent" told me on the phone, in a written email. But no one reply to me.

So I will say this is more likely the decision of the entire company, rather than an individual behavior.

In the meanwhile, fertilise your land with horse manure.

Redirect any comments/complaints to the developer stating he won't sign off for building, so it will be landscaped.

Sounds to me like the original developers have vacated the covenant by refusing to engage with you.

Edit: Before someone gets the wrong end of the stick and goes off the deep end, I'm not trying to suggest 'just go ahead and build' - it's something to bring up with a lawyer.
