Given recent comments, it's sounds like the settlement may still be an option. Hopefully so,

 

- the purchaser won't lose $61k they probably can't afford to lose,

 

- the seller receives sales proceeds.

 

Win/win is always preferable to win/lose.

Money's in the bank.

The new owner got a house in Churton Park, an upscale neighborhood for $610,000.

I forgot to mention I had a fixed price of $600,000, and even then I was willing to go to $580,000.

Didn't opt for the ever-annoying auction / best offer over / tender, because I hate that, and I'm guessing others hate it too.

So even though the real estate agent really didn't deserve $19,000 for about 8 hours work, it did get me a better deal than I anticipated.

I forgot to mention when I asked the agent whether I should grant an extension, he strongly recommended no exntension. Now I know why he would have that position.

I think there should be a rule change that the agent doesn't get paid until mortgage is settled, but now I know that's the norm.

Last thoughts: get a lawyer you can trust, and don't get a lawyer recommendation from a real estate agent ever!

You might as well be flashing huge wads of cash in a bad part of town.
