I'm insured through AA insurance, here's a quote from the policy:

"We do not provide cover while your vehicle is being used:

(several points not relevant to this)
if it would not have passed a Warrant of Fitness at the time

of the event."

A couple of cases like this have gone to court

In each case the insurance company lost. They must be able to show that not having a warrant contributed in some way to the accident.

That's good to know.
Thinking about it...
If you take it to the extreme, you could have a rear seat belt that is frayed, and not up to WOF standard. It obviously has no relevance to the front seat passengers if there's a crash.

Don't worry, insurance companies would never try to get out of a claim by using spurious reasons like that...

Not everyone will agree with me but

If you can't tell if your car is roadworthy without a WOF you probably shouldn't be driving.

If you treat driving like it is a sport (I do) then with a basic inspection and some spirited driving you should easily pick up any problems well before your local testing station. If you don't fix it straight away...like I said you shouldn't be driving.
