When I worked for VW I didn't go a day without selling 2-3 of VW Polo fuel flap locking mechanisms.
Common failure and VW knows it all too well. They wear the cost as it is a known defect. Those Polo's also like eating cam shafts and have a required update for the cam cover breather and a few seals.

The warranty conditions are an acceptable remedy for this type of issue, and a CGA claim is very likely to be unsuccessful. Based on the information provided.

Your friend should progress a claim though, and report back.

I disagree with your interpretation of the CGA. There is nothing written in the CGA that says warranty conditions are acceptable for this type of issue. The CGA does not go into such details and is intentionally quite vague, relying on peoples common sense. There are plenty of cases that prove minor faults are covered outside warranties.

Minor faults are covered by the CGA, and the liability to repair or refund is irrelevant to any manufacturer warranty that may apply.

Why do they use a system like that. What was wrong with the way most other cars do it, which I presume is a pull type wire on a level.

If it's as easy and simply and inexpensive as you say, why on earth would they ever decline to fix it? The loss of Goodwill would be many times greater. Happy customers tell 3 people, unhappy ones tell 10.

That’s a different question. I’m simply showing that the fault isn’t as dramatic as some might suggest, easily remedied, and not a CGA matter for a nearly 4 year old car.

yes it is a simple fault, you have to wonder why VW being one of the biggest car manufacturers in the world can’t get something so simple to work properly. I would go back to the dealer and ask them to fix it. After all it’s the putting right that counts

Outcome: Yesterday I phoned the Service Manager at the dealership where the car was purchased. After a brief explanation, he said ‘bring it in and we’ll take a look at it’.

Took the car in today and and he asked me to wait while they looked at the car. This gave me a chance to look longingly at some of the new cars in their showroom.

He came back 40 mins later and said they had installed a new part and no charge.

In all of this CGA was never mentioned and not even any talk of in/out of warranty period, except briefly by me on the phone at the outset.

There may be some who commented above who could be tempted to say ‘toldya so’ - and they’d be quite right.

I am pleased and a little impressed with the outcome but in hindsight maybe I shouldn’t be.

Sometimes I just sit and think. Other times I just sit.
