if you bought the phone from someone based in NZ (e.g. the firm 'Parallell Impor...' then you have rights under the CGA. 

 

If you bought from an overseas then you are in their hands.

I flew from Sydney to Christchurch yesterday morning and the announcements in the departure lounge were interesting. Some airlines made it clear that they would not carry any passenger with a Note 7 in their possession - basically "dump it at the gate or you're not boarding".

 

I flew Emirates and their policy was that as long as it remained switched off and that it not be charged onboard, they were fine to carry Note 7's.

Purchasers do, however, need to check the Samsung website first, if claiming for an import. The arrangement made by Samsung for compensation varies from country to country. Samsung has a specific agreement in place in the USA, for example, that may not apply elsewhere. (Americans are lucky in this case as a voluntary recall does not mean compensation there usually). I'm not sure what purchasers can do if they bought online, since returning them is now impossible. Contact the retailer and cross fingers, I guess 😉

The age old question over parallel importing or not is really hitting home here.

 

I have imported bits and pieces over the years but never an overly expensive item, and this is the exact reason.

 

As far as banning the phones on the plane it really should be a non-issue as they have been recalled so shouldn't be in the wild.

If you purchase something from a NZ retailer they can't opt out of the CGA so you're covered by that. The real problem is if you buy a phone overseas or from a seller based offshore. You'd hope in such a case that Samsung would look after you, but once again it goes back to weighting of the risk of buying from an authorised distributor/reseller vs parallem importing a product to save a few $$

AirNZ's policy changed over the weekend.  Last week it was "turn off, don't charge".  This week it was "not allowed on the plane at all".

 

The flight attendant told me they will be making the new announcement until sometime in January.  That's a whole lot of negative advertising for Samsung with the travelling public.

Both local store and drop ship imports.

The Americans don't, the FAA do. They are the appointed authority. Just as well, because you need a central agency to tie together all this information.

 

 

The FAA is an American agency. It has no jurisdiction in NZ.

 

However, I imagine that they could make a rule that any airline flying into the USA could not carry a Note 7 on any of its flights anywhere in the world. Whilst this is draconian and probably not legally enforceable, they could make the rule and it would work so long as no-one challenged it.

 

It could also be that NZ's CAA copied the FAA's rule. So, although the rule originated with the FAA, it is enforced here by the CAA. So whoever stated that it was due to FAA regulations wasn't entirely correct.
