If she feared the proximity and felt intimidated at any time, it's assault.

SumnerBoy: A bit dramatic surely? Whilst not a smart thing to do, I would hardly consider this anywhere near the scale of 'assault'.


It may not have malicious intent, but it is still inappropriate and very clearly unwanted attention. With his record, he should know better by now.

As someone who has slightly longer than average hair and has had to deal with strangers walking up to me to touch it (why is that okay?) or have had someone threatening that they would cut it while I wasn't looking, I can assure you that I very much consider anybody tugging on my hair repeatedly as an act of bullying. In the case of a stranger, it would be assault imo.

It seems some of you think "assault" is when someone punches another person.

Its bloody weird is what it is.

Hopefully the waitress gets to make her mind up about what she wants done without too much outside political/media/social influence.

Agreed, but without criminal intent it is not assault.  If I shoulder tap you and you didnt want me to shoulder tap you (I didnt know you didnt want me to) by your reckoning that would be assault.

In some cultures touching someone's hair is a sign of respect and greeting. In others, you have basically sexually harassed someone's wife/daughter. Shoulder tapping is not even in the same stratosphere as pulling on hair.

It caused her apprehension and upset and discomfort, that may well meet the definition of assault, but one of the Lawyers here would be better placed to advise

edit: He has already apologised. If the country has any sense it will now move on and focus on issues that affect more than a single person, like unemployment, Christchurch rebuild or the housing market.

If this were to occur in a team I managed sexual harassment procedures would be taking place. I had zero tolerance for this. I believe as a society we should demand better from leaders and role models.

It's creepy, it's wierd, and given it's not just a repeat offense against this woman but apparently something he regularly does (cue footage of him touching the young girls pony tail) its bordering on being fetish like.

We could debate all day what country hair touching is ok,bad etc. the law is clear and requires criminal intent, do you seriously think a prosecutor would charge him with assault for what was shown in the gif on page 1???  

Again my personal view is touching someones hair like this is weird, inappropriate, and stupid.  

But it is not at a level I would consider assault.  If he did it again, after being told not to, then we have criminal intent.  Just like if I shoulder tapped you again after being asked not to, it does become assault (criminal intent).

Wow, that seems an over-reaction, especially as, as soon as the waitress asked him to stop, he did, then apologised.  Perhaps if she had said "please don't touch my hair PM" at the outset, the drama could have been avoided
