Is there a a reason why you didn't sign up during the two months it was running?\

 

Anytime an offer is indicated as a limited time or while stocks last it always pays to get in quickly.

I don't think anyone here is going to support your personal crusade in getting free TV out of Spark. The offer started in August and clearly stated while stocks last, yet you waited almost 3 months to take up the offer.

 

I imagine your only option is to go to the disputes tribunal if you feel so aggrieved about it.

To correct you, it is not a free tv. It is a discounted  tv.  Also it is  two months. They have had other promotions such as their 6 month half price promotion running far far longer.

Yes, it is for a new build, and I was waiting for the conduit to be installed, and power to go live, which has gone in this week. Chrous can't install until power is connected etc.

If you are hell bent on getting a free tv then sign up with TrustPower... Otherwise you if you really have the time and effort to take it further, good luck to you.

Yes but that is one of the errors that has been made by Spark, because obviously someone at spark thought that removing the link from the website will remove the page. But most people will access it via google. I was accessing the page by googling spark tv offer. The fact that Spark has now actually removed the page, just shows that it should have been removed originally, so the offer wasn't still live on the website.

 

 

You've made several factual errors in this post.

 

- Our website team understand that removing a link removes a link and doesn't remove the page contents.

 

- Most people don't access it via Google

 

- The fact that someone has since removed the page in no way constitutes an admission that it should have been removed earlier. It was in all likelihood to reduce confusion in response to your specific concerns.

 

- The web page still existing on the web server does not mean that the offer was still live.

 

But apart from that...

The fact they did this makes your argument even less likely to succeed.  They took active steps to prevent the page showing. 

 

You are disappointed that you missed out on the deal which is understandable, but you have suffered no loss, and you have zero grounds to 'escalate' anything in my opinion.    Time to move on with your life and find the best current deal that meets your needs.  





Lazy is such an ugly word, I prefer to call it selective participation

If I can access the offer page from the server it is hosted on via the website URL, then how is that webpage not live on the internet? The fact that a link to the page is removed, so it is not a linked to from the main website doesn't mean that it won't have been indexed and accessible via other links, most importantly as google. That is the way the internet works. I didn't actually find out about this offer from the website in the first pace, it was from a Geekzone link, so I have never accessed the offer from a link off the main website in the first place, and never saw any advert or link  for this offer. I first found out about this offer on here, which was posted about a month ago  https://www.geekzone.co.nz/forums.asp?forumid=39&topicid=240480

I could if I had known about that,but it was also still a bit of an unknown over the dates. Also this TV offer was a separate promotion, so whether that would still work with that.

I don't want a 'free tv', and the Spark offer was not for a 'free tv'. I am not sure why people think it is for a free tv. The offer was for a discounted tv. I first found out about this offer on the Geekzone website a few weeks ago at https://www.geekzone.co.nz/forums.asp?forumid=39&topicid=240480 

 

The Spark offer wasn't on a long term contract. From the terms it was relatively clean 12 month contract, which didn't appear to differ from the normal 12 month contract.

While not exactly the same story this may be useful -

 

So a few years ago I was working for a retailer and we had a crazy deal on a limited quantity of phones. We put it online and it went crazy so we removed the item links from our webpage - but sadly the direct link got shared around a bunch of resellers who managed to purchase more than we had for sale due to the website only polling the retail stock system every 10 mins.

 

 

 

Because we couldn't supply one of the guys orders (for 50pcs) he took us to the disputes tribunal saying we'd cost him xxx amount of money due to us not supplying him. We had to explain / provide evidence we'd followed a process to remove the offer as soon as we knew it was selling out and show that we informed him within an hour or so of placing the order.

 

The tribunal ruled in our favour due to us taking reasonable steps to prevent the item selling and informing him promptly.

 

 

 

So, not exactly the same situation and with the DT is does kinda depend who you have presiding - but based on my experience they'd be unlikely to rule in your favour based on the info here.
