A text I received a few months ago, however it does not contain an 'opt out' link. Reading through the legislation, section 11(1) does not apply as I agreed to their privacy statement. I read their privacy statement and their words are:
You can unsubscribe from the email or text communication at any time by clicking on the “Unsubscribe” link in any email or text received from us, or by contacting our Privacy Officer
This message appears to have no opt out facility in the 'principal message' as stated in sec 11(1), so is in breach of this Act.
To sum up, take a deeper look at the legislation and the t's&c's of the website you bought off. You could have agreed without knowing.
And irregardless of legislation or rules around sending them (the scammers on the current campaign don't give a hoot, but it's still happening)
Think you'll find as Linux suggests true Premium SMS services that actually manage the in/outgoing are nationally registered much like a phone in someones pocket - for all customers on all networks to reach if they reply.
Dr Google simply finds the skinny page as it seems they are one of the well cached listings of the registered services. That is not to say the 'from' is not been spoofed. Just as the current malware campaign is.
As such, you will discover 4115 has been registered and used a number of times. And for the latter half of this year has possibly been re-issued again

But when you see people like messagemedia promoting campaigns and arranging you the 3 or 4 digit short codes. It's more them that have the number 'registered' And the provider connecting the dots to get back to their management system.
Mobile providers can investigate the routing to find who sent if a registered premium company service like this with access to send them. But they're certainly not the source/cause.
