I am aware of that and is the new Motorola handset going to work on SparkNZ VoLTE?

Correct they may be a Sub model for Spark and a Sub model for OneNZ
I guess time will tell......

Harvey Norman are selling them "open network" , Im hoping its the same as the one as Im getting .
I dont think they would sell incompatible phones .

As quickymart said, probably heaps. You only need to look at some of the ex-lease PC places pushing machines that aren't compatible with Windows 11 amongst "Fortnite compatible" PCs (I can't remember if I saw some of those that'd be stuck on Windows 10).
So long as they're careful with the wording, neither would really be breaking any laws, there are legit reasons for old phones or PCs that aren't compatible with current software and updates to be on the market. So long as they don't decieve mainly (such as promise/imply it'll work on a particular network with knowledge of upcoming changes that would stop it working - Consumer NZ named PB Tech a while back as potentially falling foul of this at one stage and they had to rush to get a solution for some of the phones they sold).
