Reading through the C.G.A, the store/manager has breached at least four sections of the act. With serious faults, such as not being able to perform the job or task it was intended for, the choice lies with the consumer, they (the store doesnt get any say in the choice) can choose refund, replacement or to keep the goods and accept suitable conpensation to make up for a loss in value.

Yeah, but because it's an intermittent fault, they could argue that it was a minor problem in which case they were doing what they were supposed to. I brush up on the CGA quite regularly to make sure I'm following the rules. Thank heavens there's no definition for "reasonable time" when I'm bombarded with 12 repairs a day for two weeks and I can only complete 8 per day!

I wouldn't shop there again. LE, Orb, and TMM all offer the same deals. So if this one company is giving you that much grief, take your business elsewhere. The fact the LE dealer has a "hotline" for folks like yourself who have trouble with TMM speaks for itself.

If i can get the refund that i want (hell will freeze over before i want that phone again) im going to take my money and walk round the corner to the orb or leading edge store, havent decided which and give them my money, altough VF are still a very real possibility at this stage. The absolutely crap treatment i have received has left me wanting to wash my hands of Telecom altogther. Especially when you are treated like an idiot and made to feel like the whole thing is your fault

edit:

Seven months is not intermittent

Loving it!!!! So many great things about it, far too many to list. Being able to change to colour of the standy screen font is real handy as with some wallpapers on other phones you couldnt see time/date etc.

I aint ever letting go of this.

One small prob with it though. I got my refund and went round to the orb store. Didnt like the number that came with the phone so the dealer went through a list of available numbers to put on the phone. Got home, phone wouldnt work, called *123. Turns out the number didnt exist. Now having to wait for another new number to be provisioned
