Hey all, excuse the question as I'm no law expert
There is a huge discussion going on regarding regarding the court case regarding the XT mobile network interfering with Vodafone's network.
A similar discussion was sort of started on Vodafone's own forum but since locked due to the matter being before the courts, more to protect themselves I guess incase any of their staff made a comment about it or speculation going wild.

With vodafone staff being able to post on this forum, is there a chance they are putting their company at risk still with the topic being open? or is it just a case of "post at your own risk?"

I locked the Forum thread because the discussion kept circling around about the court case despite me saying several times that we could not and would not be answering questions about it until after the hearing.

Vodafone staff cannot comment on the case because it's before the court. To do so would be to prejudice the case and is frowned upon by the courts... and such frowning leads my boss to frown at me and me to frown at the commentator and so on down the chain and oh it'll all end in tears.

This sucks, now both companies are going to spend hundreds and thousands of dollars on court costs, which means they'll need to charge us more to cover the cost.

If what is occuring is true, Vodafone should have raised it a long time ago and Telecom shouldn't have been so negligent when building its network.

Shame on both of them!!!!!!!!

While it's certainly VF's view that TNZ was negligent, we (geekzone readers and the general public) don't have enough information to make that determination. In fact, based on the information that became public yesterday, we still haven't received a report that would let us make that determination. There is a long discussion on geekzone that goes into good detail on the different types of interference and how they might be happening here. That really depends on the type of interference, and the type of problem being caused in VF's network. Several of the possible situations are VF's to resolve, not TNZ.

However, I guess for an injunction, they only have to show a reasonable chance of winning in a court case. They don't have to demonstrate actual culpability. Culpability is determined during the follow-up court case.

Good to see court case has been resolved - pity tho that I need to wait an extra few weeks to move from VF to XT....

from a soon to be e ex VF 6 year cust! Hope XT have the Apple iph - if not HTC will no nicely!
