Just go straight to TDR. Don't let Vodafone bully you into either staying with them or paying that absurd fee. If Vodafone cannot hold up their end of the bargain, they have no right to expect you to hold up yours.

Not surprised they wouldn't let you move to VDSL - that would cost them more in the long run. Time for you to consider your options. I like the TDR option.

Regarding the TDR, looking at their website I get the impression this has been tried before:

 

 

TDR notes it is uncommon for a Scheme Member to make any particular undertaking as to Internet speed which a customer is likely to receive. The usual position is that the service provided will be a 'best efforts' service. TDR acknowledges that such a situation is in large measure a consequence of the variables noted above.

 

Generally TDR is not able to consider any complaints relating to Internet speed or congestion, as they are expressly excluded from the scope of the Customer Complaints Code.

 

However, TDR may be able to consider a complaint relating to a broadband service is the following situations:

 

     

  1. When the Scheme Member made an undertaking to the customer, or marketed their product as having a particular minimum speed. Such complaints will be considered under the Fair Trading Act 1996.
  2. When the complaint relates to a customer being unable to establish a reliable Internet connection. TDR considers that irrespective of the actual speed received, the customer should be able to establish a reasonably reliable Internet connection.

 

Going off Vodafone's site they don't state a minimum speed of cable, only that it will go upto 100 megabit, also even when it runs at 2 megabit things still function.

 

Has anyone had any luck with the TDR over congestion/slowness?

I would suggest Vodafone cable falls under the definition of unreliable if it can't consistently be used for its intended purpose. The TDR clauses relate more to people complaining about reduced speeds, not unusable speeds.

I've talked to Vodafone over the last couple of days.  I only just re-signed for 12 months and told them I'd expect the break fee to be waived considering the terrible performance in our new house - it seemed likely they would waive it in this scenario being that it's only been a few days since the move.

 

 

 

However, they are unable to put an order through for VDSL because their address checker doesn't show my house as being VDSL capable, though the Spark website says the houses on either side of us are (though not ours oddly enough).

 

 

 

My only recourse was to get a discount, which will be $20 a month on top of an existing $10 discount I already get while on contract (and a $10 On Account mobile discount).  So I'm paying $60/month now for 100/10 that drops to 6 in the evenings, until the upgrades go through.  It's inconvenient, but the best deal I'm going to get in the circumstances.  I just have to make sure I think ahead about what I want to download so I can do it earlier in the day, because it's not feasible in the evening.  At least I'm still getting up to 100mbps in the middle of the day I guess.

I don't know, never dealt directly with Chorus before as it's normally all handled by the ISP.

The Chorus broadband checker, as well as the one on the Spark website, essentially come up with a NULL result.  That is, it doesn't say that xDSL or Fibre isn't available, and it doesn't say that it is available... it literally says nothing, on both websites.  It is very odd, like it just has no data for the address whatsoever.  The Vodafone address checker says Cable is here obviously, but no xDSL either - though the tech I talked to yesterday did say something about me being able to switch to ADSL, though she didn't really seem to know what she was talking about.

 

 

 

I haven't bothered checking with another ISP, thought I might give Spark a call because I thought their relationship with Chorus might be better than Vodafone's, but when I looked at their broadband prices - and even Bigpipe's - I don't think they're competitive enough that I want to switch from Vodafone to get what will probably be a ~30mbps VDSL connection.  Chances are I'd need a master splitter installed in the house as well which I'd probably have to pay for.

Installing a master filter is easy. Grab a kit of TradeMe for $30 and install it yourself. To be honest I'm not even sure if I have one and given there are several jacks in the house I should. Will check tonight.

 

You're definitely not going to get the same dollar-for-throughput from VDSL as you will with cable during off-peak hours, but during peak it wins hands down, at least for now. I'm also getting better latency and none of the weird DNS issues Vodafone cable is well known for. 

 

At the end of the day I realized that for me having a connection that just worked when I needed was more important than the overall bandwidth capability. Sure, having 100Mbps is great, but most of the time 35Mbps is more than enough and the few occasions where 100Mbps makes a real difference are just that: few. Paying a premium for extra bandwidth I wasn't using off-peak and sub-ADSL bandwidth on-peak just doesn't make sense.

As of about a week and a half ago, I've joined you on WKH. While there has been slow down during the peak congestion times, the internet has still been usable. 

 

My ping is almost invariably 10-11ms using Speedtest.net, but more like 25ms using nPerf. So yours seem to be especially bad.

I've been experiencing the same as Sideface: Bandwidth is overall more tolerable, but my latency has been driving me insane. I've even had a couple of odd, rare disconnects while playing games.
